Review and Adoption of Meeting Notes

  • ACTION: Commissioner Ryan moved to adopt the meeting notes from the November 30, 2011 ACCS meeting.
    • Commissioner Davis seconded the motion.
    • Yes Votes: Commissioners Barber, Bauer, Davis, Kovacic, Ryan, Thomsen
    • No Votes: None
    • Abstentions: Commissioners Baltazar, Washington
    • Absent: Commissioner Porter
    • The motion passed with six votes.
ITEM 4: Consideration of Requests for Determination of Funding as Required for Nonclassroom-based Charter Schools Pursuant to California Education Code sections 47612.5 and 47634.2.
  • ACTION: Commissioner Mark Ryan moved to adopt the recommendation by the CDE.
    • Commissioner Barber seconded the motion.
    • Aye Votes: Commissioners Baltazar, Barber, Bauer, Davis, Kovacic, Ryan, Thomsen, Washington
    • No Votes: None
    • Abstentions: None
    • Absent: Commissioner Porter
    • The motion passed with eight votes.
ITEM 1: Dixon Montessori Charter School: Consider a Material Revision of the Charter to Increase Enrollment.
  • ACTION: Commissioner Barber moved to approve CDE recommendation.
    • Commissioner Kovacic seconded.
    • Aye Votes: Commissioners Baltazar, Barber, Bauer, Davis, Kovacic, Ryan, Thomsen, Washington
    • No Votes: None
    • Absent: Commissioner Porter
    • The motion passed with eight votes.
ITEM 2: Western Sierra Collegiate Academy: Consider a Material Revision of the Charter to Expand Grade Levels Served and Amend Graduation Requirements.
  • ACTION: Commissioner Barber moved to support CDE recommendation and further recommend the State Board of Education allow the Western Sierra Collegiate Academy to—at their own discretion—adopt graduation requirements as low as the a-g requirements without further approval from the State Board of Education.
    • Commissioner Thomsen seconds.
    • Aye Votes: Baltazar, Barber, Bauer, Davis, Kovacic, Ryan, Thomsen, Washington
    • No Votes: None
    • Absent: Commissioner Porter
    • The motion passed with eight votes.
ITEM 3: Long Valley Charter School: Consider Issuing a Notice of Violation Pursuant to California Education Code Section 47607(d) and Consider a Request for a Material Revision of the Charter to Increase Enrollment and Add Resource Centers.
  • ACTION: Commissioner Barber moved to support CDE recommendation and recommend denial of the material revision.
    • Commissioner Washington seconds.
    • Aye Votes: Commissioners Baltazar, Barber, Bauer, Davis, Kovacic, Porter, Ryan, Thomsen, Washington
    • No Votes: None
    • The motion passed with nine votes.
    • Commissioner Barber moved to support CDE recommendation to issue a notice of violation and to further recommend the school develop an action plan to cure or provide evidence that substantiates or rebuts the notice of violation.
    • Second by Commissioner Porter.
    • Aye Votes: Commissioners Baltazar, Barber, Bauer, Davis, Kovacic, Porter, Ryan, Thomsen, Washington
    • No Votes: None
    • The motion passed with nine votes.
ITEM 5: Recommendations Regarding Revocation of Charter Schools Identified Pursuant to California Education Code Section 47604.5 and California Code of Regulations, Title 5 Section 11968.5.
  • ACTION: Commissioner Ryan moved to support the State Superintendent of Public Instruction and staff’s recommendation.
    • Commissioner Kovacic seconds.
    • Aye Votes: Commissioners Baltazar, Barber, Bauer, Kovacic, Porter, Ryan, Thomsen, Washington
    • No Votes: None
    • Absent: Commissioner Davis.
    • Motion passed with eight votes.
