Review and Adoption of Meeting Minutes

AGENDA ITEMS

ITEM 1: Renewal Petition for the Establishment of a Charter School Under the Oversight of the State Board of Education: Consideration of the Anahuacalmecac International University Preparatory High School (AIUPHS) which was denied by the Los Angeles Unified School District and the Los Angeles County Office of Education.

California Department of Education (CDE) Recommendation:

CDE’s recommendation is to deny the renewal petition to establish the AIUPHS charter school under the oversight of the SBE based on the CDE’s finding pursuant to EC sections 47605(b)(1), 47605(b)(2), 47605(b)(5), as well as California Code of Regulations, Title 5 (5 CCR) Section 11967.5, that the petitioners are unlikely to successfully implement the program set forth in the petition.

 

ITEM 2: Lifeline Education Charter School: Consider a Material Revision of the Charter to Change from Grades Six Through Twelve to Kindergarten Through Grade Twelve.

CDE Recommendation:

CDE proposes approve the request to revise the LECS charter petition to increase enrollment to 554 and change grades served from six through twelve to K through grade twelve.

 

ITEM 3: Petition for Establishment of a Charter School Under the Oversight of the State Board of Education: Consideration of the Magnolia Science Academy—Santa Ana, which was denied by the Santa Ana Unified School District and the Orange County Office of Education.

CDE Recommendation:

The CDE has no recommendation at this time.

 

ITEM 4: Charter Revocation: Information regarding the Commencement of the Rulemaking Process to Repeal California Code of Regulations, Title 5, Section 11968.5.

CDE Recommendation:

This item is being provided to the Advisory Commission on Charter Schools to determine whether it would like to provide public comment for consideration as part of the rulemaking process. Comments from the Advisory Commission on Charter Schools will be documented and provided to the Board.

 

ITEM 5: Consideration of Requests for Determination of Funding as Required for Nonclassroom-based Charter Schools Pursuant to California Education Code Sections 47612.5 and 47634.2, and Associated California Code of Regulations, Title 5.

CDE Recommendation:

The CDE proposes to recommend that the SBE approve the determination of funding for the following nonclassroom-based charter schools:

Taylion High Desert Academy - 100% for 2 Years (2013–14 through 2014–15)

Center for Learning and Unlimited Educational Success - 100% for 2 Years (2013–14 through 2014–15)

Oxford Preparatory Academy - 100% for 2 Years (2013–14 through 2014–15)

Taylion San Diego Academy - 100% for 2 Years (2013–14 through 2014–15)

Learning Community Charter School - 100% for 4 Years (2014–15 through 2017–18)

California Virtual Academy @ Fresno - 100% for 3 Years (2014–15 through 2016–17)

ITEM 6: Consideration of “Reasonable Basis”/Mitigating Circumstances Requests for Determination of Funding as Required for Nonclassroom-based Charter Schools Pursuant to California Education Code Sections 47612.5 and 47634.2, and Associated California Code of Regulations, Title 5.

CDE Recommendation:

CDE proposes to recommend that the SBE approve the proposed determination of funding for charter schools that offer nonclassroom-based instruction identified in the following schools:

Excel Prep Charter School – IE – 100% for 2 Years (2014-15 through 2015-16)

Academy of Arts & Sciences – El Cajon Middle & High School - 100% for 2 Years (2014-15 through 2015-16)

Academy of Arts & Sciences – Del Mar Elementary - 100% for 2 Years (2014-15 through 2015-16)

Academy of Arts & Sciences – Del Mar Middle & High School - 100% for 2 Years (2014-15 through 2015-16)

Academy of Arts & Sciences – Sonoma - 100% for 2 Years (2014-15 through 2015-16)

CDE proposes to recommend that the SBE approve the proposed determination of funding for charter schools that offer nonclassroom-based instruction identified in the following schools:

Mt. Lassen Charter School - 85% for 4 Years (2014-15 through 2017-18)

Big Sur Charter School - 100% for 4 Years (2014-15 through 2017-18)

Santa Rosa Academy - 85% for 4 Years (2014-15 through 2017-18)

CDE proposes to recommend that the SBE approve the proposed determination of funding for charter schools that offer nonclassroom-based instruction identified in the following schools:

The Classical Academy, Inc. - 85% for 5 Years (2014-15 through 2018-19)

 

ITEM 7: Reconsideration of Requests for Determination of Funding as Required for Nonclassroom-based Charter Schools Pursuant to California Education Code Sections 47612.5 and 47634.2, California Code of Regulations Section 11963.6(g), and Associated California Code of Regulations, Title 5.

CDE Recommendation:

The CDE proposes to recommend approval for a 100 percent funding determination, replacing the previously approved determination of funding currently in effect for fiscal years (FYs) 2013-14 through 2016-17.

ITEM 8: Consideration of a Retroactive Request for Determination of Funding as Required for Nonclassroom-based Charter Schools Pursuant to California Education Code Sections 47612.5 and 47634.2, and Associated California Code of Regulations, Title 5.

CDE Recommendation:

The CDE proposes to recommend that the SBE approve a 100 percent determination of funding for Yuba City Charter School, for a three year period beginning from FY 2012–13 through 2014–15, with the condition that the Yuba City Charter School receives an SBE-approved waiver to allow consideration to include current and prior FYs for the charter school’s requested determination effective period.

ITEM 9: Consideration of a “Reasonable Basis”/Mitigating Circumstances Retroactive Request for Determination of Funding as Required for Nonclassroom-based Charter Schools Pursuant to California Education Code Sections 47612.5 and 47634.2, and Associated California Code of Regulations, Title 5.

CDE Recommendation:

CDE proposes to recommend that the SBE deny Butterfield Charter High School’s mitigating circumstances request of 60 percent for FY 2013–14 through 2014–15.
