Chair Bauer called the meeting to order at approximately 10:05 a.m.

    • Vicki Barber moved approval and Gary Davis seconded.
    • Yes Votes: Brian Bauer, Kelly Kovacic, Vicki Barber, Gary Davis, and Julie Russell.
    • No Votes: None
    • Abstentions: Mark Ryan

AGENDA ITEMS

Item 1: Consideration of Requests for Determination of Funding as Required for Nonclassroom-based Charter Schools Pursuant to California Education Code sections 47612.5 and 47634.2.

CDE Recommendation: The California Department of Education (CDE) proposes to recommend that the SBE approve the proposed determination of funding, identified in Attachment 1, for charter schools that offer nonclassroom-based instruction. The CDE revised its recommendation to pull California Virtual Academy at Kings, California Virtual Academy at Sonoma, and Vantage Point Charter School due to mitigating circumstances that need to be considered. These will be heard at the August ACCS meeting

  • MOTION: Mark Ryan moved to accept CDE recommendation to approve the funding with the removal of the 3 schools and with exception of Charter School #1146 (one.Charter);
    • SECOND: Kelly Kovacic.
    • Yes Votes: Brian Bauer, Kelly Kovacic, Julie Russell, Vicki Barber, Mark Ryan, and Gary Davis.
    • No Votes: None
    • Abstentions: None
    • With 6 votes, the motion passes.
  • MOTION: Mark Ryan moved to accept the CDE recommendation for funding for Charter School #1146 (one.Charter);
    • SECOND Kelly Kovacic seconded the motion.
    • Yes Votes: Brian Bauer, Kelly Kovacic, Julie Russell, , Mark Ryan, and Gary Davis.
    • No Votes: None
    • Abstentions: Vicki Barber
    • With 5 votes, the motion passes.
Item 2: Consideration of Requests for Determination of Funding for Prior Years as Required for Nonclassroom-based Charter Schools Pursuant to California Education Code sections 47612.5 and 47634.2, and California Code of Regulations title 5, section 11963.4(c).

CDE Recommendation: The California Department of Education (CDE) proposes to recommend that the SBE approve the proposed determination of funding, identified in Attachment 1, for charter schools that offer nonclassroom-based instruction.

  • MOTION: Mark Ryan moved to accept CDE recommendation to approve the funding;
    • SECOND by Gary Davis
    • Yes Votes: Brian Bauer, Kelly Kovacic, Julie Russell, Vicki Barber, Mark Ryan, and Gary Davis.
    • No Votes: None
    • Abstentions: None
    • With 6 votes, the motion passes.
Item 3: Petition for Establishment of a Charter School Under the Oversight of the State Board of Education: Consideration of the Schools and Communities for Advanced Learning Experience Charter Petition, which was denied by the Rialto Unified School District Board of Education and the San Bernardino County Board of Education

CDE Recommendation: The California Department of Education (CDE) proposes to recommend that the SBE hold a public hearing to deny the petition to establish the SCALE charter school under the oversight of the SBE based on the CDE’s finding pursuant to EC sections 47605(b)(1), 47605(b)(2), and 47605(b)(5) as well as California Code of Regulations, Title 5 (5 CCR) Section 11967.5 that the petitioners are unlikely to successfully implement the program set forth in the petition.

  • MOTION: Vicki Barber moved to accept CDE recommendation to deny the petition to establish SCALE charter school under the oversight of the SBE.
    • SECOND by Mark Ryan.
    • Yes Votes: Brian Bauer, Kelly Kovacic, Julie Russell, Vicki Barber, and Mark Ryan.
    • No Votes: Gary Davis
    • Abstentions: None
    • With 5 votes, the motion passes.

Lunch Break

RECESS for lunch called at 12:10 pm to reconvene at 1:05 pm. The meeting was reconvened at 1:10 pm.

Item 4: Petition for Establishment of a Charter School Under the Oversight of the State Board of Education: Consideration of Portola Academy, which was denied by the Livermore Valley Joint Unified School District Board of Education and the Alameda County Office of Education.

CDE Recommendation: The California Department of Education (CDE) proposes to recommend that the SBE deny the petition to establish the Portola Academy under the oversight of the SBE based on the CDE’s finding pursuant to EC sections 47605(b)(1) and 47605(b)(5) and California Code of Regulations, Title 5 (5 CCR) 11967.5.1 that the petitioners are unlikely to successfully implement the program set forth in the petition.

  • MOTION: Vicki Barber moved to recommend that the State Board approve the petition to establish Portola Academy under the oversight of the SBE.
    • SECOND by Gary Davis.
    • Yes Votes: Brian Bauer, Kelly Kovacic, Gary Davis, Vicki Barber, and Mark Ryan.
    • No Votes: Julie Russell
    • Abstentions: None
    • With 5 votes, the motion passes.
