Call to Order

Chair Bauer called the meeting to order at 10:03 a.m.

GENERAL BUSINESS

Chair Bauer announced that the State Board of Education (SBE) is currently accepting applications for two seats on the ACCS.

Vicki Barber announced that she will not be reapplying for a seat on the ACCS when her term expires in December 2012.

  • Action: Mark Ryan moved to approve the notes from the June 14, 2012, ACCS meeting.
    • Vicki Barber seconded the motion.
    • Yes Votes:    Bauer, Barber, Davis, Russell, Ryan
    • No Votes:     None
    • Abstentions: Porter, Thomsen, Washington

AGENDA ITEMS

Item 1: Consideration of Requests for Determination of Funding as Required for Nonclassroom-based Charter Schools Pursuant to California Education Code sections 47612.5 and 47634.2.

California Department of Education (CDE) Recommendation:

The CDE proposes to recommend that the SBE approve the proposed determination of funding, identified in Attachment 1, for charter schools that offer nonclassroom-based instruction.

  • Action: Mark Ryan moved that the ACCS recommend a five-year funding determination for charter schools: #0320 (Long Valley Charter), #0650 (Folsom Cordova Community Charter School), #0277 (Pacific View Charter School), #1135 (iQ Academy California – Los Angeles), #1158 (Keegan Academy), and #1248 (Milestones Cooperative Charter).
    • Vicki Barber seconded the motion.
    • Yes votes:    Barber, Bauer, Ryan, Thomsen
    • No votes:      Davis, Russell, Porter, Washington
    • With a 4-4 vote, the motion failed.

 

  • Action: Gary Davis moved to accept the CDE recommendation for funding determinations, identified in Attachment 1, for charter schools:  #0320 (Long Valley Charter), #0650 (Folsom Cordova Community Charter School), #0277 (Pacific View Charter School), #1135 (iQ Academy California – Los Angeles), #1158 (Keegan Academy), and #1248 (Milestones Cooperative Charter).
    • Yes Votes:    Barber, Bauer, Davis, Porter, Russell, Thomsen, Washington
    • No Votes:     Ryan
    • With 7 votes, the motion passes.

 

  • Action: John Porter moved to approve the CDE recommendation for four years of funding for charter schools: #0395 (Eleanor Roosevelt Community Learning Center) and #0586 (MET Sacramento Charter High School).
    • Christopher Thomsen seconded the motion.
    • Yes Votes:    Bauer, Davis, Porter, Russell, Thomsen, Washington
    • No Votes:     Ryan
    • Recusal:       Barber
    • With 6 votes, the motion passes.

 

  • Action: Christopher Thomsen moved to approve the CDE recommendation for charter school #1179 (Harvest Ridge Cooperative Charter School) to receive 100 percent funding for two years.
    • Curtis Washington seconded the motion.
    • Yes Votes:    Bauer, Davis, Porter, Russell, Ryan, Thomsen, Washington
    • No Votes:     None
    • Recusal:       Barber
    • With 7 votes, the motion passes.

 

ITEM 2: Petition for Renewal of a Charter School under the Oversight of the State Board of Education: Consideration of Rosie the Riveter, which was denied by the Long Beach Unified School District and denied consideration of appeal by the Los Angeles County Office of Education.

CDE Recommendation: The CDE proposes to recommend that the SBE hold a public hearing to deny the Rosie the Riveter Charter High School renewal petition based on the CDE’s findings pursuant to California Education Code (EC) sections 47605(b)(1), 47605(b)(2), and 47605(b)(5) as well as California Code of Regulations, Title 5 (5 CCR) Section 11967.5 that the petitioners are unlikely to successfully implement the program set forth in the petition.

  • Action: Vicki Barber moved to approve the CDE’s recommendation that the SBE deny the appeal for renewal of the Rosie the Riveter Charter High School.
    • Mark Ryan seconded the motion.
    • Yes Votes:    Bauer, Barber, Davis, Porter, Russell, Ryan, Thomsen, Washington
    • No Votes:     None
    • With 8 votes, the motion passes.

 

ITEM 3: Petition for Establishment of a Charter School under the Oversight of the State Board of Education: Consideration of Creating Opportunities for Relationships and Learning (CORAL) Academy, which was denied by the Monterey Peninsula School District and the Monterey County Office of Education.

CDE Recommendation: The CDE proposes to recommend that the SBE hold a public hearing to deny the petition to establish the CORAL Academy under the oversight of the SBE based on the CDE’s findings pursuant to California Education Code (EC) sections 47605(b)(1) and 47605(b)(5) as well as 5 CCR Section 11967.5 that the petitioners are unlikely to successfully implement the program set forth in the petition.

  • Action: Mark Ryan moved that the ACCS delay making a recommendation until its December meeting, with the condition that the Petitioner agree to extend by 30 days the 120-day deadline (pursuant to 5 CCR Section 11967) by which the SBE must act before the petitioner is able to seek judicial review.
    • John Porter seconded the motion.

    • No Votes:     None
    • Abstentions: Russell
    • With 7 votes, the motion passes.
