NOTICE OF REQUEST TO WAIVE 14-DAY PUBLIC SCHOOL CHOICE PARENT NOTIFICAITON REQUIREMENT
Request for public comment on California’s request to waive the federal 14-day public school choice notification required for local educational agencies (LEAs) and schools with high school students that will be newly identified for Program Improvement (PI) in 2010–11.
Notice is hereby given that California has requested the U.S. Department of Education (ED) to waive Title I, Part A requirements (34 Code of Federal Regulations § 200.37(b)(4)(iv)).
The purpose of this public notice is to notify you of the opportunity to submit written public comment on the waiver request to the ED regarding the 14-day parent notification requirement for PI LEAs and schools. California is requesting that LEAs and schools with high school students, where graduation data is required to make a PI determination, have their PI identification delayed until graduation data become available. Due to delayed identification, LEAs and schools are unable to provide parents with the required notification within the 14-day timeline required by federal law. The waiver would permit LEAs and schools to delay notification until a final PI determination can be made in November, at which time, LEAs and schools would have 14 days to notify parents of their PI status.
