Dear Publishers Participating in the 2007 Mathematics Adoption of Instructional Materials for Kindergarten Through Grade Eight:
*Enclosed are computer-generated forms to be used for the submission of price quotations for newly submitted materials under adoption consideration in the subject area of Mathematics. The price quotations shall be in effect from the date the State Board of Education (SBE) adopts the newly submitted programs (scheduled for November 2007) to June 30, 2009. Biennial price adjustments shall take place for materials adopted from this submission beginning July 1, 2009. The newly adopted materials shall remain adopted until the SBE conducts a new primary adoption in this subject area. Price decreases shall be allowed at any time after the SBE adopts materials from this submission.
This cover letter describes the purpose of the enclosed forms. Instructions regarding the completion of line items on the forms are included in this packet. The forms list those materials under consideration for the 2007 State Board of Education Mathematics adoption. Bids should be submitted only for those items for which the publisher/producer intends to fill orders. Penalties may be incurred if adopted materials are not available throughout the adoption period.
It is imperative that all cost and expense data be submitted as described in the instructions. Bids received without the appropriate UNIT PRICE, FREIGHT, AND TOTAL COST expense quotations could result in the exclusion of your materials from adoption.
Materials for which formal bids are not received by the stipulated deadline will be considered withdrawn from the adoption process. Prices may not be increased after the final filing date of the price quotation bids until the next scheduled biennial price updates. Any violation of this requirement will be immediately reported to the State Board of Education and all school districts.
Price submissions must be in compliance with the state’s “most favored nation” clause. Subsection (a) of Education Code Section 60061 requires that a publisher or manufacturer shall furnish the instructional materials offered at a price not exceeding the lowest price offered to any state or school district in the United States.
