Dear M. Publisher:

At its meeting on November 8, 2007, the State Board of Education (SBE) elected not to approve Publisher’s Program for the 2007 Mathematics Primary Adoption. This letter contains information regarding the final steps of this adoption process.

RETRIEVAL OF NON-ADOPTED MATERIAL

The 2007 Mathematics Primary Adoption Publishers Invitation to Submit (p. 26) authorizes publishers who wish to retrieve non-adopted materials from the Learning Resource Display Centers (LRDCs) to do so. Publishers have until December 10, 2007, to retrieve non-adopted materials. This must be done without any cost to the LRDCs. If you want to retrieve your materials, a list of LRDCs with contact information is provided in the attachment. Please check with each LRDC to see if packing materials or other help is needed for a prompt return of materials. Materials not retrieved by December 10, 2007, will be disposed of or donated for educational use.

NON-ADDOPTED MATERIALS APPROVED FOR LEGAL COMPLIANCE

Though your program was not adopted by the SBE, it is eligible to be placed on the Legal and Social Compliance Catalog once all legal and social compliance citations have been corrected and those corrections approved by the California Department of Education (CDE) in the final print materials. You must clearly represent these materials as “approved for legal compliance” or “approved for social content compliance” but NOT

as “state approved,” “state adopted,” or any other term or phrase implying that the materials have been approved or adopted by the SBE, Curriculum Commission, CDE, or other agency of the State of California. Misrepresentation may result in deletion of the affected item from the list of materials approved for legal compliance.

Please submit your final print materials reflecting the revisions approved for legal and social compliance by February 6, 2008, to:

EDITS AND CORRECTIONS

Since your programs were not adopted by the SBE, you are not required to make the edits and corrections that were listed in the 2007 Mathematics Primary Adoption Curriculum Commission Advisory Report. However, if you plan to market your instructional material as a supplemental program approved for legal and social compliance, it is recommended that you consider making those corrections with the next printing of your materials.
