Closed			Ms. Brenda Miller 199 South Los Robles, Ste. 700 Phone:  Fax:  Email:  bmiller@ofy.org Web-Site:  www.ofy.org	School Start Date:  2/9/1996 Numbered by SBE: 2/9/1996 Charter Type: Start-up Funding Mode: Direct Status Effective Date: 6/30/2011 Status Reason: Closed: 2/8/11, Upland USD denied renewal based on the following facts of finding: school did not meet the four ASAM indicators: Attendance, Course Completion, Credit Completion and High School Graduation; renewal petition failed to plan for staffing, finances, curriculum, calendars or other necessary details to enable the District to review and assess the viability of the proposed classroom-based instruction; despite a finding and corrective action to resolve a CDE Compliance complaint from March 2010, OFY continues to improperly handle special education students according to the law; OFY failed to submit a budget and cash flow projections; the Petitioners stated affirmatively that payment of excess costs for special ed students will satisfy the necessity to contribute to the District's encroachment under EC 47646: this provision is not acceptable with the District; OFY has had a growing ending balance over the last five years, indicating the funds are not being spent on student programs; OFY has not provided full transparency on fund transactions; the petition states the District 'shall not be permitted to withhold, as a remedy or otherwise' any funds received on behalf of the charter, which is neither an acceptable, nor permissible provision; OFY has attempted to expand facilities without a material revision, and the renewal petition would allow expansion at the will of OFY; Petitioners inaccurately informed the District they had withdrawn from the West End SELPA to become a member of San Gabriel SELPA, causing CDE to intervene to inform the charter school they had not met the legal requirements to withdraw students; the petition is presented as a contract for signature by the parties and contains elements not appropriate for a petition but items that would inappropriately bind the parties; there is not clear evidence that the contracts entered into by the school are the result of a fair bid process; the charter is not a District alternative school and does not have the right to submit waiver requests under EC 58509; charter failed to provide a calendar, as such fails to show viability of programs; and the charter proposes the District must give the charter a non-renewal notice 'not less than eighteen months' prior to expiration of the term. The petition includes an illegal consequence that failure tofu the District to give such notice would result in automatic renewal for the charter. This provision ignores the requirement that the Charter must meet certain academic indices as a condition of renewal.
