Letter Head: Jack O'Connell, State Superintendent of Public Instruction, California Department of Education

May 15, 2008

Dear County and District Superintendents of Schools:

STATEMENT OF ASSURANCE
STATE INSTRUCTIONAL MATERIALS FUNDING
FISCAL YEAR 2007-08

California Education Code (EC) Section 60242.5 provides that all purchases of instructional materials made from allocations from the State Instructional Materials Fund (IMF) shall conform to law and applicable rules and regulations adopted by the State Board of Education. That section also requires the superintendent of each school district and county office of education to provide a written assurance of such conformance to the State Superintendent of Public Instruction (SSPI).

To comply with that requirement, please complete the enclosed Statement of Assurance State Instructional Materials Funding, Fiscal Year 2007-08 (Statement of Assurance) form and return to the address below by July 31, 2008. (This form is also available on the CDE Web site at http://www.cde.ca.gov/fg/aa/ca/imfrp.asp). A local educational agency’s fiscal year 2008-09 IMF monies are at risk until such time as the assurance is received by the SSPI.

The Statement of Assurance applies to any IMF funds expended for instructional materials during fiscal year 2007-08, including carryover funds, such as Senate Bill 550 (Chapter 900, Statutes of 2004) funds to implement the Williams settlement.

Frequently Asked Questions (FAQ) regarding instructional materials can be found at http://www.cde.ca.gov/ci/cr/cf/imfrpfaq1.asp, which includes Williams settlement requirements. Please note the Statement of Assurance does not require local board approval and is distinct from the sufficiency of text books resolution per EC Section 60119.

Please return a completed Statement of Assurance form by July 31, 2008, to:
