Dear County Superintendents of Schools, Auditors, and Treasurers:

NOTICE OF THE RECOVERY OF OVERPAYMENTS FOR THE
KINDERGARTEN THROUGH GRADE THREE CLASS SIZE REDUCTION
PROGRAM FROM THE FINAL APPORTIONMENT
FISCAL YEAR 2005-06

This recovery of overpayment in the amount of $29,196,667, is made pursuant to California Education Code Section 52124(d). The overpaid amount to each district or charter school is based on the final entitlement, computed using the final enrollment counts submitted on form J-7CSR, as compared to the total amounts paid in the advance and provisional apportionments. Additionally, the entitlement amounts have been adjusted for those basic aid districts that selected the K-3 CSR program pursuant to Section 17 of Senate Bill 65 (Chapter 491, Statutes of 2005) and the procedures set forth in Section 27 of Senate Bill 63 (Chapter 73, Statutes of 2005). In accordance with California Education Code Section 52125(d), overpaid funds will be recovered from the next monthly principal apportionment payment.

The enclosed schedule indicates the amount overpaid to each district or charter school in your county. The State Controller will deduct the overpayment from the July 2006 Principal Apportionment. County Superintendents of Schools are requested to immediately inform each affected district or charter school of the adjustment and provide each with a copy of this letter and schedule.
