Dear Select County Superintendents of Schools, Auditors, and Treasurers:
This recovery of overpayment, in the amount of $126,192, is made pursuant to California Education Code (EC) Section 52124(d). In September 2006, an advance apportionment for the 2006-07 Kindergarten Through Grade Three Class Size Reduction (K-3 CSR) Program was certified in accordance with EC Section 52126(g)(1). However, some local educational agencies that received the advance funding based on their program participation in 2005-06 did not participate in 2006-07 or participated at a lower level, and were thus overpaid. The overpaid amount to each district or charter school is based on its entitlement, computed using the final enrollment counts submitted on form J-7CSR, as compared to the total amounts paid in the advance and provisional apportionments.
A portion of the overpaid amount was recovered in the July 2007 principal apportionment, however, some amounts are still owing. In accordance with EC Section 52124(d), overpaid funds are to be recovered from the next principal apportionment payment or other apportionment of state funds to the district. As such, the State Controller will deduct the remaining overpayment from the February 2008 principal apportionment payment. County superintendents of schools are requested to immediately inform each affected district and charter school of the adjustment.
