Dear Select County Superintendents of Schools, Auditors, and Treasurers:
REVISION TO THE NOTICE OF THE FIRST RECOVERY OF OVERPAYMENTS FOR
THE KINDERGARTEN THROUGH GRADE THREE CLASS SIZE REDUCTION PROGRAM FROM THE PRINCIPAL APPORTIONMENT
FISCAL YEAR 2007-08
As a result of new information, we request that this letter supersede our letter dated February 15, 2008, regarding the recovery of overpayments for the Kindergarten Through Grade Three Class Size Reduction (K-3 CSR) Program.
This revised request to recover overpayments, in the amount of $113,449, is made pursuant to California Education Code (EC) Section 52124(d). In October 2007, an advance apportionment for the 2007-08 K-3 CSR Program was certified in accordance with EC Section 52126(g)(1). However, some local educational agencies that received the advance funding based on their program participation in 2006-07 are not participating in 2007-08 or are participating at a lower level. In accordance with EC Section 52124(d), which states that a district shall not retain any funds it receives for any class or grade that is not participating in the K-3 CSR Program, the State Superintendent of Public Instruction and State Controller are required to recover the amount overpaid.
