Dear County Superintendents of Schools and Treasurers:
This apportionment, in the amount of $1,798,079, is made from funds provided in Section 3 of Assembly Bill 56 (Chapter 31, Statutes of 2009-10, Third Extraordinary Session, ABx3 56) and in Section 5(f)(1) of Assembly Bill 3 (Chapter 3, Statutes of 2009-10, Fourth Extraordinary Session, ABx4 3), as amended by ABx3 56. It provides 90 percent of fiscal year 2009-10 funding to county offices of education (COEs) in support of county oversight activities associated with the Quality Education Investment Act of 2006 (QEIA), established in California Education Code (EC) sections 52055.700 through 52055.770.
Pursuant to EC Section 52055.770(i)(1), the formula for allocating these funds is similar to that for allocating funds to COEs in support of county oversight activities required under the Williams v. California settlement agreement. Consistent with that formula, established in EC Section 1242, COEs receive $2,500 per participating elementary school, $3,500 per participating middle or junior high school, and $5,000 per participating high school for QEIA oversight activities. They also receive additional funding for participating schools whose October 2008 California Basic Educational Data System (CBEDS) enrollment exceeds certain thresholds, as follows:
In addition, COEs that are responsible for visiting more than 36 participating schools receive $0.51 per enrolled pupil at those schools based on October 2008 CBEDS enrollment.
Overall, each COE will receive no less than $10,000.
EC Section 52055.770(i) provides that not more than $2,000,000 will be provided to COEs for this program. Total funding provided for fiscal year 2009-10, however, is only $1,997,864, since total QEIA funding available for the fiscal year for all local educational agencies is 0.10679 percent less than the total QEIA entitlement.
