Dear  County Superintendents of Schools, Assistant Superintendents for Curriculum and Instruction, Auditors, and Treasurers:

NOTICE OF FIRST APPORTIONMENT FOR
SUPPLEMENTAL INSTRUCTIONAL MATERIALS FOR ENGLISH LEARNERS
FISCAL YEAR 2006-07

This apportionment, in the amount of $27,000,037, is made from one-time funds provided in Section 43(a)(10) of Assembly Bill (AB) 1802 (Chapter 79, Statutes of 2006) to provide supplemental instructional materials for English Learners (EL) in kindergarten and grades one through twelve. It is made to local education agencies (LEAs) that elected to participate in the program by submitting particular forms to the California Department of Education (CDE) by April 5, 2007. Entitlement is equal to $21.3613 times the number of English Learner pupils in kindergarten and grades one through twelve as certified in the Language Census of 2006. Ninety percent of the entitlement is being paid by this apportionment, with the remaining ten percent to be paid in the spring of 2008. LEAs have until June 30, 2009, to encumber the funds; any unencumbered funds as of that date shall be returned to the State.

The funds are required to be used to purchase supplemental materials that are designed to help EL students in kindergarten and grades one through twelve become proficient in reading, writing, and speaking English. These materials may only be used in addition to the standards-aligned programs adopted by the State Board of Education (SBE) pursuant to California Education Code Section 60605.

LEAs may purchase any of the instructional materials that are listed on the AB 1802 certified list posted on the CDE Web site at http://www.cde.ca.gov/ci/cr/cf/englearnrs.asp.

In addition, funding may be used only for the number of pupils that the LEA certified it would purchase materials for when it elected to participate in the program. LEAs have the flexibility to expend more than the per pupil allocation on different grade levels, but not more than thirty dollars ($30) per pupil from these funds for these materials. LEAs must return any funds not expended for the purchase of the supplemental materials pursuant to Section 43(a)(10)(A) of AB 1802.

The CDE contracted with two county offices of education to conduct reviews of the new materials requested by LEAs. The reviewers using the matrices developed by the CDE, adopted by the SBE, and filled-out by the publishers ensure that the materials are substantially correlated to the English Language Arts (ELA) and English Language Development (ELD) content standards.

Warrants for this apportionment will be mailed to county treasurers within four weeks of the date on this Notice. For standardized account code structure (SACS) coding, use Resource Code 7157, Instructional Materials: English Language Learners (One-Time), and Revenue Object Code 8590, All Other State Revenue. County superintendents of schools are requested to inform LEAs immediately of this apportionment. A list of participating LEAs and the allocation to each will be posted on the CDE’s Web site at http://www.cde.ca.gov/fg/fo/r4/elsm06result.asp.
