Applicants who wish to appeal a grant award decision must submit a letter of appeal to the California Department of Education (CDE). Appeals are limited to the grounds that the CDE failed to correctly apply the standards for reviewing the applications as specified in this Request for Applications. The appellant must file a full and complete written appeal, including the issue(s) in dispute, the legal authority or other basis for the appeal position, and the remedy sought. The letter must have an original signature of the authorized person who signed the application. The appeal should be delivered or mailed to:
ASES Program Appeal
After School Programs Office
California Department of Education
1430 N Street, Suite 6408
Sacramento, CA 95814-5901
The CDE must receive the letter of appeal within ten days of the intent to award announcement. The CDE must receive the letter of appeal, with an original signature by the authorized person who signed the application, no later October 8, 2010. The CDE will not consider incomplete or late appeals or appeals that merely refute the evaluators’ comments (which are provided for technical assistance alone).
The CDE staff or designees will re-evaluate the application. The Deputy Superintendent of the P-16 Policy and Information Branch or designee will make the final decision in writing within 30 days of the receipt of the appeal by the After School Programs Office. That decision shall be the final administrative action afforded the appeal. The sole ranking for this proposed award is the applicant’s Free and Reduced Meal Program (FRPM) as listed in DataQuest.
