The U.S. Department of Agriculture (USDA), Food and Nutrition Service (FNS), has issued Policy Memoranda SP 28-2013 (v. 2)—Questions and Answers on the School Breakfast Program (SBP) Meal Pattern in School Year (SY) 2013–14 and SP 45-2013—Updated Offer versus Serve (OVS) Guidance for the National School Lunch Program (NSLP) and SBP in SY 2013–14. The FNS issued SP 28-2013 to provide questions and answers regarding the New Meal Pattern (NMP) requirements for breakfast established under Section 201 of the Healthy, Hunger-Free Kids Act of 2010, Public Law 111-296. SP 45-2013 provides detailed guidance for OVS for both the NSLP and SBP. Both memos are available on the USDA FNS School Meals Policy Memos Web page at http://www.fns.usda.gov/cnd/Governance/policy.htm.

Offer versus Serve

SP 45-2013 provides detailed guidance for the implementation of OVS for the NSLP and the SBP. Of important note is a significant change to OVS in the SBP related to implementation of the breakfast changes effective July 1, 2013. Original guidance stated that a student may only decline one food item no matter how many items are offered. The updated guidance in this memo now states that a student must take at least three food items.
