Title II CMIS Levels A, B, and C

Accountability requirements for Title II Part A.

Local Educational Agencies (LEAs) in the Title II Compliance Monitoring, Interventions, and Sanctions (CMIS) Program

Level A

An LEA that fails to demonstrate 100 percent Highly Qualified Teacher (HQT) compliance, as reported on the California Longitudinal Pupil Achievement Data System (CALPADS), becomes identified for CMIS Level A and is subject to Title II accountability requirements below.

2009-10 Title II Accountability Requirements
  1. Complete the Non-Compliant Teacher Action Plan (XLS) for each school site that has any ESEA core academic courses taught by teachers who are not Highly Qualified.
  2. Submit copies of the completed documents electronically by November 15 of each year to:

Level B

LEAs with less than 100 percent highly qualified teachers in ESEA core academic subjects for two consecutive years are required to submit and Equitable Distribution Plan (EDP) to the CDE by June 24 of each year.

Level C

LEAs with less than 100 percent highly qualified teachers in ESEA core academic subjects and that fail to make Adequate Yearly Progress (AYP), for three consecutive years, shall enter into an agreement with the CDE per the provisions of Section 2141(c) of the ESEA. 

CMIS Level C Section 2141 (c) Accountability Requirements

LEA is placed in CMIS Level C and is subject to ESEA Section 2141 (c) fiscal accountability requirements and shall enter into an agreement with the California Department of Education (CDE).  The agreement consists of a Memorandum of Understanding (MOU) (DOC), Budget Agreement (DOC), and Non-Compliant Teacher Action Plan (XLS).

LEA notified in September of each year that it is subject to Section 2141 (c) accountability requirements.

Submit copies of the completed documents electronically by November 15 of each year to:

A LEA is subject to 2141 (c) accountability requirements for the duration of the school year.

If the LEA again fails to meet 100 percent highly qualified teachers in ESEA core academic subjects and fails to meet AYP for the current school year, the LEA is subject to Section 2141 (c) accountability requirements for the following school year.
