ATTENTION: PROGRAM DIRECTORS OF CHILD DEVELOPMENT PROGRAMS EXCEPT STATE PRESCHOOL, BAY AREA HANDICAPPED, AND RESOURCE AND REFERRAL
PURPOSE
The purpose of this Management Bulletin (MB) is to rescind and replace MB 00-14 and MB 05-05 and to transmit a revised Family Fee Schedule that will take effect January 1, 2007. All families must have their fees assessed according to this revised schedule no later than February 1, 2007. In addition, this MB supercedes the policy noted in MB 06-13 that instructs program directors and/or contractors to continue utilizing the current family fee schedule as noted originally in MB 00-14 (effective September 1, 2000).
This schedule reflects an upward adjustment in monthly family income that is derived from the State Median Income (SMI) as determined by the California Department of Finance (DOF) for 2005. The monthly ceilings establish the maximum monthly income amount per family size that may be earned and represent the maximum fee amount that a family will pay.
BACKGROUND
Education Code (EC) Section 8263(f) authorizes the State Superintendent of Public Instruction to establish a fee schedule for families utilizing child care and development services pursuant to Chapter 2 (Sections 8200 et seq.) of Part 6 of Title 1 of the EC. This schedule applies to child care and development services, including CalWORKs child care funded by the California Department of Education (CDE) and Department of Social Services, with the exception of the following programs: State Preschool, Bay Area Handicapped, and Resource and Referral.
EC Section 8447(e) requires the DOF to provide the CDE with an updated SMI each year. This section of the EC also requires the CDE to adjust the family fee schedule to reflect the updated SMI.
POLICY
All families are subject to the fee schedule with the following exceptions:
- Families with at risk children may be exempt from paying fees if a legally qualified professional in a legal, medical, or social services agency or emergency shelter determines the fee waiver to be necessary.
- Child Protective Services (CPS) families may be exempt from paying a fee for up to 12 months if determined to be necessary by the county welfare department, child welfare services worker.
- Families may be exempt from paying fees for no more than a total of 12 cumulative months.
MB 06-14 transmitted additional information regarding fee collection for children who are at risk or receiving CPS.
Pursuant to EC Section 8263.1, the family income eligibility ceiling is 75 percent of SMI for all child care and development programs to which this fee schedule applies.
Fee Assessment
For family child care home education networks reimbursed under the Regional Market Rate and Alternative Payment programs, full-time care is defined as enrollment for six or more hours per day, while part-time care is enrollment for less than six hours per day.
Full-time and part-time fees are assessed based on the program type the family is using and the number of hours per day the child is enrolled.
For family child care home education networks reimbursed under the Standard Reimbursement Rate and for center-based programs, full-time care is defined as enrollment for 6.5 or more hours per day, while part-time care is enrollment for less than 6.5 hours per day.
School-Age Community Child Care (“Latchkey”) Programs operate on a quarter day (less than 2.5 hours per day) basis. Families served at this level shall be charged a fee equal to one-half of the part-time fee shown on the schedule. Example: A family of three whose gross monthly income is $2,280 and whose child with the longest period of services is less than 2.5 hours per day will be assessed one half of the part-time fee of $2.00 or $1.00 per day.
The hourly fee should be used only for Latchkey programs that are reimbursed by the CDE on an hourly basis and for those families enrolled in hourly increments.
