ATTENTION: Executive Officers and Program Directors of All Child Care and Development Programs
Purpose
The purpose of this Management Bulletin (MB) is to provide information regarding the enrollment and transfer of children into the new California State Preschool Program (CSPP). It also discusses changes to the CDD-801A monthly reporting requirements resulting from the passage of Assembly Bill (AB) 2759. These changes became effective beginning with the July 2009 reporting period.
Contractors operating a Migrant, Bay Area Handicapped, Family Child Care Home Network or Alternative Payment Program are not required to adhere to this MB.
Statutory Requirements
California Education Code (EC), Section 8235 requires the State Superintendent of Public Instruction to consolidate into the CSPP the funding and program requirements for the five largest center-based programs providing services to CSPP eligible three- and four-year-old children. These programs include State Preschool part-day (CPRE) and full-day (CFDP) programs, Prekindergarten and Family Literacy part-day (CPKP) and full-day (CPKF) programs, and General Child Care and Development (CCTR) programs.
For purposes of determining CSPP age eligibility, the following definitions apply:
- CSPP eligible three-year old children are defined as children who turn three-years old on or before December 2 of the fiscal year in which they are receiving services.
- CSPP eligible four-year-old children are defined as children who turn four-years old on or before December 2 of the fiscal year in which they are receiving services.
- Five-year old children are defined as children who turn five-years old on or before December 2 of the fiscal year in which they are receiving services.
Background:
On September 25, 2008, AB 2759 was signed into law creating the CSPP. The program became operative on July 1, 2009. In November 2008, the Child Development Division (CDD) released MB 08-13 notifying CPRE, CFDP, CPKP, CPKF and CCTR contractors providing services to CSPP eligible three-and four-year old children in a center-based setting of changes to contract requirements as a result of the passage of AB 2759. MB 08-13 provided information and instructions on the consolidation of the funding for CPRE, CFDP, CPKP, CPKF, and CCTR contractors that currently provide service to CSPP eligible three- and four-year old children in a center based setting.
The Child Development Management Information System (CDMIS) Web site was created in May 2001 to enable agencies to electronically submit their CDD-801A (monthly population reports) and CDD-801B (monthly sample reports) through a secure internet connection.
Program Requirements
Effective July 1, 2009, contractors that had a CCTR, CPRE, CFDP, CPKP, or CPKF contract in Fiscal Year 2008-2009 and completed the CSPP application process pursuant to MB 08-13, were issued a CSPP contract for FY 2009-2010. Contractors that operated a CPKP or CPKF program in FY 2008-2009 must continue to provide services in the attendance area of an elementary school in deciles one (1) to three (3), based on the 2005 Academic Performance Index, under the CSPP contract. Additionally, these contractors continue to receive funding, under a separate Prekindergarten and Family Literacy Support (CPKS) contract, to provide family literacy services pursuant to EC, Section 8238.1.
As of July 1, 2009, only CSPP eligible three- and four-year old children shall receive services under the CSPP. Five-year old children receiving services as of June 30 can continue to receive services in either a CCTR or CSPP through the summer until the beginning of the academic year the child is eligible to start kindergarten, pursuant to EC, Section 48000(a).
It is permissive, when developmentally appropriate, for CSPP eligible three-year-old children receiving CCTR services to remain in a toddler setting of a CCTR program until the day before their third birthday. These children are eligible for reimbursement using the toddler adjustment factor as long as they are being served in a classroom staffed pursuant to California Code of Regulation, Title 5 (5 CCR), Section 18290(b).
Contractors that operated a CPKP or CPKF program in FY 2008-2009, and continue to receive Prekindergarten and Family Literacy Support funding in FY 2009-2010, may operate under one of the following options:
- Contractors may continue to serve CSPP eligible four-year old children only. This option will permit contractors to enroll families above the income eligibility thresholds pursuant to EC, Section 8238.4(a)(4). After enrolling all otherwise eligible children; contractors may enroll up to 20 percent of their contracted slots with children receiving part-day/part-year services in families whose income is above income eligibility threshold.
- Contractors, under provisions in EC Section 8238.4(d), may elect to serve CSPP eligible four- and three-year old children. This option will permit contractors to enroll families above the income eligibility thresholds pursuant to EC Section 8235(c). After enrolling all otherwise eligible children; contractors may enroll up to 10 percent of their contracted slots with children receiving part-day/part-year services in families whose income is no more than 15 percent above income eligibility threshold.
Transferring and Enrollment of Children
- As of July 1, 2009, CSPP eligible three- and four-year old children who were enrolled and receiving services in a CFDP, CCTR, or CPKF contract on June 30, 2009, should have been transferred and reported as follows:
- CSPP eligible three-year old children may be transferred as follows:
- Those children being served in a preschool classroom staffed pursuant to 5 CCR, Section 18290(c), should be transferred to the CSPP and reported on the CDD-801A using the CSPP program code.
- Children who turn three between July 1 and December 2 of the fiscal year they are being served can remain in a CCTR toddler classroom staffed pursuant to 5 CCR, Section 18290(b), until the day before their third birthday. These children are reported on the CDD-801A using the CCTR program code.
- All CSPP eligible four-year old children must be transferred to the CSPP and reported on the CDD-801A using the CSPP program code.
- CSPP eligible three-year old children may be transferred as follows:
- As of July 1, five-year old children that are eligible for kindergarten pursuant EC, Section 48000(a) and were enrolled and receiving services in a CFDP, CCTR, or CPKF contract on June 30, 2009 may :
- Continue to receive services in the CCTR program until the beginning of the academic year they are eligible to start kindergarten, but no later than September 30, 2009. These children are reported on the CDD-801A using the CCTR program code.
- Be transferred to the CSPP until the beginning of the academic year they are eligible to start kindergarten, but no later than September 30, 2009. These children are reported on the CDD-801A using the CSPP program code.
- Effective July 1, CSPP eligible four-year old children who were enrolled and received services in a CPRE or CPKP contract as a three-year old, may be enrolled pursuant to 5 CCR, Section 18131(b)(1), and receive part-day/part-year services in a CSPP.
Contractors formerly operating a CPRE program and as of July 1, 2009 providing part-day/ part-year services under a CSPP contract may, for families applying for part-day/part year services:
- Certify eligibility no more than 120 calendar days prior to the first day of the new preschool year.
- Enroll up to 10 percent of their contracted slots with children in families that are no more than 15 percent above the income eligibility threshold.
Contractors formerly operating a CPKP contracted program and as of July 1, 2009 providing part-day, part-year services under a CSPP contract may, for families applying for part-day/part year services:
- Begin to certify eligibility no more than 120 calendar days prior to the first day of the beginning of the new preschool year.
- Continue to provide services under the provisions of EC, Section 8338.4, serving only CSPP eligible four-year old children and the ability to enroll up to 20 percent of their contracted slots with children in families that are above the income eligibility threshold pursuant to EC, Section 8238.4(a)(4), or
- Pursuant to EC, Section 8238.4(a)(3), elect to serve both CSPP eligible three- and four-year old children with the ability to enroll up to 10 percent of their contracted slots with children in families that are no more than 15 percent above the income eligibility threshold pursuant to EC, Section 8235(c).
After serving CSPP eligible four-year old children who were enrolled and received part-day/part-year services the prior fiscal year pursuant to 5CCR 18131(b)(1) and any children eligible to transfer pursuant to EC, Section 8263(c), CSPP enrollment must be in the following priority order:
- First priority shall go to CSPP eligible four-year old or three-year old neglected or abused children who are recipients of child protective services or who are at risk of being neglected or abused.
- Second priority shall go to CSPP eligible four-year old children in income ranking order.
- Third priority shall go to CSPP eligible three-year old children in income ranking order.
Changes to CDD-801A Monthly Reporting:
Beginning with the July 2009 report month CPRE, CFDP, CPKP, and CPKF program codes will not be accepted. The July 2009 CDD-801A requires the new program code to be used to report the age eligible children who are being served under the new program.
When reporting under CSPP, the system will restrict reporting of children as follows:
- Only CSPP eligible three- and four-year old children will be accepted for part-day/part-year services. This means that, effective July 1, 2009, for fiscal year 2009-10, the system does not accept children with a birth date of December 3, 2006, or later. These children will be eligible for the CSPP program on July 1, 2010. Additionally, children with birth dates prior to December 2, 2005, will only be accepted through June 2010.
- For full-day, full-year service, in addition to CSPP eligible three- and four-year old children, five-year-old children will be accepted through the September reporting period to allow continuation of services until they enter kindergarten.
Example: A CSPP eligible four-year old child, who was enrolled in fiscal year 2009/10 and is receiving full-day/full-year services on June 30, 2010 in the CSPP, may continue to receive full-day/full-year services as a five-year-old until the day before they enter kindergarten, but no later than September 30, 2010.
When reporting under the CCTR, the system will restrict reporting of children as follows:
- CDD-801A allows CSPP eligible three-year old children whose birth dates are between July 1 and December 2 to be reported under this contract type only until the child’s third birthday.
Example 1: A child, who turns three-years old on October 1, may be enrolled and receive services in a CCTR toddler classroom until September 30, the day before the child turns three-years old. On October 1 the agency shall transfer the child to the CSPP. For CDD-801A reporting, the child shall be reported using the CCTR program code for the September report, and the CSPP program code for the October report.
Example 2: A child who turns three years-old on November 15, may be enrolled and receive services in a CCTR toddler classroom through November 14, the day before the child turns three years old. On November 15, the child shall be transferred to the CSPP. For CDD-801A reporting, the child shall be reported using both the CCTR program code (through the 14th) and the CSPP program code (beginning the 15th) for November. For December, the child shall be reported on the CDD-801A report using the CSPP program code.
- CSPP eligible three- or four-year-old children can be served in a CCTR program when those services are provided in a licensed family child care home setting.
