Purpose
The purpose of this Management Bulletin (MB) is to:
- Supersede MB 11-37 and 10-24; and
- Update instruction for reporting data on the number of children and families who access Stage 2 due to “Diversion Services.”
Background
Chapter 38, Statutes of 2012 (Senate Bill 1016) added Section 8263.3 to the California Education Code (EC). EC Section 8263.3(a) requires the California Department of Education (CDE) to, effective July 1, 2012; reduce the Maximum Reimbursable Amounts of the contracts for the General Child Care, Migrant Day Care, Alternative Payment, CalWORKs Stage 3, and Allowance for Handicapped programs. This may require contractors to terminate families currently receiving services in these programs.
The CDE recognizes County Welfare Departments (CWDs) may be approving “Diversion Services” to any family who was receiving subsidized child care and development services, and who was issued a Notice of Action. The CWDs are the agencies responsible for the determination of eligibility for the county’s CalWORKs Diversion Services. As part of this determination, the CWD must provide the applicant/family with documentation of eligibility approval. Documentation from the CWD would include the type of Diversion Services that were approved (e.g., cash aid or child care) and the effective date of those services.
A family approved for Diversion Services may then be eligible for CalWORKs Stage 2 child care services. California Code of Regulations, Title 5, Section 18409.5 requires that any family entering CalWORKs Stage 2 who is not transferring from a CWD’s Stage 1 program or another Stage 2 contractor must apply to the Stage 2 contractor for services, and a contractor must review the application and certify eligibility.
CalWORKs Stage 2 contractors must follow the directives in MB 12-09 to continue to transfer families who have been approved for Diversion Services into the program and provide services.
Directive
It is critical that the Child Development Division (CDD) collect and report timely and accurate information on the impact of Division Services to Stage 2. CalWORKs Stage 2 contractors are asked to complete Attachment A (XLS), on a monthly basis, to report the number of children and families enrolled in Stage 2 due to the approval of Diversion Services by a CWD.
