Dear Select County and District Superintendents and Charter School Administrators:

Notification to Local Educational Agencies Failing to Meet
Title III Annual Measurable Achievement Objectives
for Four Consecutive Years

The purpose of this letter is to notify you that your local education agency (LEA) has been identified as failing to reach the Annual Measurable Achievement Objective (AMAO) targets. LEAs receiving Title III funds are identified by the California Department of Education (CDE) for technical assistance status when, for each of four consecutive years, the LEA does not meet AMAO targets (No Child Left Behind [NCLB] Act of 2001 Section 3122 [b][4]). Information regarding Title III Accountability Reports is available on the CDE Web site at http://www.cde.ca.gov/sp/el/t3/acct.asp.

NCLB Requirements for Title III Subgrantees

LEAs failing to meet AMAO targets for four consecutive years must do the following:

  • Notify all parents of English learner (EL) students within 30 days after public release of the Title III Accountability Reports on September 28, 2007. Parent letters must be mailed by October 29, 2007 (NCLB Section 3302 [b][c]). Sample parent letters are available on the CDE Title III Accountability Web site at http://www.cde.ca.gov/sp/el/t3/acct.asp. These sample letters include all the information required for such notice, but we encourage you to personalize it and include as much specific information as possible regarding student achievement in your district and the steps that will be taken to improve.
  • An LEA team shall be established and required to attend a three-day forum with three to five members representing significant leadership roles that may include the district superintendent, site principals, the Title III program director, the bilingual coordinator, curriculum and instructional administrators, and EL experts.
  • Register for the Modesto or Riverside Title III Year 4 Forum to engage in a collaborative endeavor to modify the curriculum, program, and method of instruction provided to EL students. Registration information is posted on the CDE Web site at http://www.cde.ca.gov/sp/el/t3/acct.asp.

  • Collaborate with regionally identified county office of education (COE) representatives to complete an analysis of information from assessments and survey tools. Use the information to identify factors contributing to AMAO failure. COE representatives and LEA team members will develop an Action Plan to modify curriculum, program, and method of instruction.
CDE Technical Assistance and NCLB Title III Year 4 Forums

The CDE, in collaboration with the California Comprehensive Center at WestEd, will provide three-day forums to develop Action Plans specifying the modifications necessary to ensure successful achievement of AMAO targets in the future. LEAs identified for corrective action under Title I accountability guidelines will also comply with Title I requirements.

The forums will provide a setting for teams to use existing inquiry tools such as the English Learner Subgroup Self Assessment and other surveys with an emphasis on ELs. The CDE has developed an Action Plan template and will provide training for submission of plans to the online Web site.
