Dear Select County and District Superintendents and Charter School Administrators:

Elementary and Secondary Education Act, Title III, Part A, Section 3115–Immigrant Education Student Sub-grant Program 2010–11

The purpose of this letter is to provide apportionment information and new payment and reporting protocols for the Elementary and Secondary Education Act (ESEA), Title III, Part A, Immigrant Education Student Sub-grant Program for the 2010–11 fiscal year (FY).

Apportionment Information for Fiscal Year 2010–11

This apportionment notification provides spending authority for the FY 2010–11 sub-grant. For consortium, the lead local educational agency (LEA) is the sub-grantee and acts as the fiscal agent on behalf of all member LEAs of the consortium.

In FY 2010–11, the formula allocation of Title III funds resulted in a per pupil allocation of $105 for each eligible public school immigrant student reported on the Student National Origin Report (SNOR) in March 2009. SNOR data submitted by private schools that have requested to participate in the Immigrant Education Student Sub-grant Program for the 2010–11 FY has been included in the total allocation for each LEA. Acceptance of Title III, Part A, Immigrant Education Student Sub-grant Program funds acknowledges that the Program and General Assurances will be observed. Copies of these assurances, agreed to by the superintendent or designee as part of the application process, can be found on the Title III Notices of Apportionments Web page at http://www.cde.ca.gov/sp/el/t3/tiiiapportnotify10.asp [Note: the preceding link is no longer valid, for more information please contact Patty Stevens at 916-323-5838.]. Please review these assurances to ensure compliance with federal guidelines.

Federal Programs Alignment

LEAs will not receive future apportionment notifications from the Language Policy and Leadership Office. To align with other federal programs, Title III Immigrant Education Student Sub-grant Program allocation amounts will be posted on the Consolidated Application (ConApp) Program Entitlements Web page at http://www.cde.ca.gov/sp/el/t3/immigrant.asp in November of each year.

Federal Cash Management Data Collection System

Beginning with the FY 2010–11 sub-grant, LEAs will report cash balances and payments will be processed through the federal Cash Management Data Collection (CMDC) system. Your LEA should have received the “Title III Addition to Cash Management Data Collection System” letter dated November 17, 2010, which provides information regarding this new Title III protocol.
