Dear Select Superintendents and Charter School Administrators:

Notice of Improvement Status under Title III of No Child Left Behind

California Department of Education (CDE) records document that your local educational agency (LEA) is the lead of a Title III funded consortium. Based upon the 2008-09 Title III accountability reports, your consortium did not meet annual measurable achievement objectives (AMAO) for two consecutive years and is subject to improvement activities under Title III. The lead LEA of the consortium is responsible for submitting the Year 2 Improvement Plan Addendum to the CDE in order to meet Title III consortia accountability requirements. The lead and members of the consortium have agreed to this in your memorandum of understanding. The consortium lead should convene the members to address the issues that are outlined in this letter. A single plan will be due from each consortium to address English learner issues for all districts in the consortium. Special attention should be given to addressing the needs of students whose scores contributed to the consortium’s failure to meet AMAO targets.

Title III Requirements

Your consortium is subject to the following Title III Year 2 requirements:

  1. Within 30 days of the public release of the Title III Accountability Reports (October 15, 2009), notify parents of English learners that the LEA did not meet Title III AMAO. Sample letters, in both English and Spanish, are available on the CDE Title III Accountability Requirements Web page at http://www.cde.ca.gov/sp/el/t3/t3amaotargets.asp.

    According to recent guidance from the United States Department of Education, the consortium lead is responsible for ensuring that parents of English learners in both the lead and member LEAs are notified if AMAOs are not met. The lead can delegate responsibility to each of the consortium members.
  1. Develop an Improvement Plan Addendum (IPA) to the LEA Plan in consultation with the CDE (No Child Left Behind Act of 2001 Section 3122[b][2][3]). The IPA directions are available on the CDE Title III Accountability Technical Assistance Web page at http://www.cde.ca.gov/sp/el/t3/t3amaotargets.asp.

  2. Submit the IPA as a Microsoft Word document to LEAP@cde.ca.gov by January 15, 2010.

  3. Complete a submittal form that must contain original signatures of the district superintendent and the district Title III English Learner Coordinator/Director. The submittal form can be found on the Title III Accountability Technical Assistance Web page at http://www.cde.ca.gov/sp/el/t3/t3amaotargets.asp.
  1. Implement the IPA.
