Dear Private School Administrator:

ANNUAL FILING OF THE PRIVATE SCHOOL AFFIDAVIT AND PASSWORD

The California Education Code (EC) Section 33190 requires private schools to file a Private School Affidavit (PSA) with the State Superintendent of Public Instruction between October 1 and 15 of each year. Schools required to file the Affidavit include for-profit and nonprofit private schools; and nonpublic, nonsectarian schools (NPS). Schools with six or more students will be listed in the Private School Directory.

By filing the PSA, private schools help their students avoid truancy and support public school districts in providing an exemption from the state's Compulsory Public School Attendance law (EC 48200). Students and teachers in nonprofit private schools and NPS that have filed an Affidavit become eligible to receive programs and services supported by the Elementary and Secondary Education Act (ESEA). The California Department of Education (CDE) notifies public school districts of this eligibility via the Consolidated Application, which enables an eligible nonprofit private school to participate in the ESEA private school consultation process with the local public school district.

Additionally, two questions have been added to the PSA regarding immigrant students in your school as required by Section 9303 of the ESEA, as amended.

The 2010 PSA will be available online October 1, 2011. To file online, visit the CDE Filing the Private School Affidavit Web page and refer to the enclosed instructions that include a unique password assigned to your school. Please file the PSA during the statutory filing period: October 1–15, 2011.

To File the PSA Online:

  1. Access the PSA Web page.
  2. Scroll down to the link for “Existing school with six or more students.”
  3. Using the A-Z Index, click on the first letter of your school’s name.
  4. Scroll down the list until you locate your school by name and address.
  5. Verify that you have the correct school by checking the address of the school.
  6. Click on “Fill out Affidavit for this school.”
  7. Enter your school’s unique eight-digit password; using the password will pre-fill several fields of information.
  8. Complete the Affidavit. Note: An asterisk (*) denotes a field that is required in order to submit the form.
  9. Click the “Submit Form” button to send the form electronically.
  10. If the form was submitted successfully, the screen will display “Form Submitted” the date and a “Confirmation” number. If this information does not display, please call our office for assistance.
  11. Print a copy of the completed Affidavit showing the confirmation number and retain it for your records.
