Under the Individuals with Disabilities Education Improvement Act (IDEA 2004), the California Department of Education (CDE) is responsible for conducting additional monitoring activities based on the data submitted by school districts through the California Special Education Management Information System (CASEMIS). Suspension and Expulsion
The CDE must identify districts that have a significant discrepancy from the state rate regarding suspension and /or expulsion for greater than ten days in the school year. In addition, the CDE must identify districts that have a significant discrepancy by race or ethnicity for suspension and/or expulsion for greater than ten days in the school year. To do this, the CDE has calculated a statewide rate of suspension and/or expulsion for greater than 10 days (0.45) and added a 2 percent variation, resulting in the state bar of 2.45 percent. Districts identified to have a rate greater than the state bar of 2.45 percent, either overall and/or by race/ethnicity, are required to review their policies, procedures and practices related to the development and implementation of Individualized Education Programs (IEPs), the use of positive behavioral interventions and supports, and procedural safeguards.
The CDE must identify districts that have disproportionate representation in special education based on race and ethnicity – both in general (State Performance Plan Indicator 9) and by disability (State Performance Plan Indicator 10). If a district is found to have disproportionate representation, the state is required to monitor districts to ensure that their policies, procedures and practices are compliant and do not lead to inappropriate identification.
