The California Department of Education (CDE) and the State Board of Education (SBE) jointly submitted eight waiver requests to the United States Department of Education (ED). The granted waiver requests pertain to Title I, Part A of the Elementary and Secondary Education Act (ESEA) given the significant new funding for programs provided by the American Recovery and Reinvestment Act (ARRA) allocations for 2009-2010 and the proposal to repeal provision 34 Code of Federal Regulations (CFR) Section 200.47(b)(1)(iv)(A), (B). LEAs seeking SBE approval for the waivers granted by ED will be expected to meet all application criteria and may be subject to increased SBE accountability requirements, in addition to specific requirements related to these waivers.
Title I, Part A, ARRA Waivers Approved
The request by local educational agencies (LEAs) to waive up to six types of requirements pertaining to Title I, Part A of the Elementary and Secondary Education Act (ESEA) relating to the American Recovery and Reinvestment Act (ARRA) allocations for the 2009-10 fiscal year was approved by the State Board of Education (SBE) at its May 2010 meeting. The list provided identifies the individual LEAs and their specific waiver requests.
