Petitions Requesting a Charter Restart

Additional Parent Empowerment provisions for petitions that request a charter restart.

Upon the receipt of the petition that requests a restart model type of intervention, and that includes a charter petition, the Local Educational Agency (LEA) must first determine whether it will implement the requested intervention option. 

If a petition requests that the Subject School be operated under a specific charter school operator, CMO or EMO, and the LEA does not reject the petition pursuant to California Code of Regulations, Title 5 (5 CCR) Section 4802.1 (g) then the review process will be the process required in California Education Code (EC) Section 47605(b) External link opens in new window or tab., with the exception of EC Section 47605(b)(3) External link opens in new window or tab.

If a Parent Empowerment petition does not include the proposed charter but requests that the Subject School be operated under a charter school operator, CMO or EMO, and the LEA does not reject the petition pursuant to 5 CCR Section 4802.01 (g), then the LEA must promptly notify the petitioners that it has adopted the restart model and give the petitioners the option to solicit charter proposals from charter school operators, CMOs and EMOs and select a specific charter school operator or decline to do so.

If the petitioners request a restart option to operate the school under an educational management organization that is not a charter school, the LEA will work in good faith to implement a contract with a provider selected by the petitioners. In the absence of petitioners' selection of a specific provider, the LEA will immediately solicit proposals from EMOs, and will select an EMO through the rigorous review process required in EC Section 53300.
