For the purposes of the Parent Empowerment provisions, a Subject School is identified by the State Superintendent of Public Instruction (SSPI) as a school that fits the following criteria:
- Is not one of the persistently lowest-achieving schools pursuant to California Education Code Section 53201.
- Has been in corrective action (DOC) pursuant to paragraph (7) of Section 1116(b) of the federal Elementary and Secondary Education Act for at least one full academic year.
- Has failed to make Adequate Yearly Progress (AYP).
- Has an Academic Performance Index (API) score of less than 800.
