CAHSEE Requirement
- All students must satisfy the CAHSEE requirement, as well as all other state and local requirements, in order to receive a California public high school diploma.
- The CAHSEE requirement can be satisfied by passing the exam or, for students with disabilities, receiving a local waiver (Education Code Section 60851(c)) or an exemption (Education Code Section 60852.4).

Pending Regulations Changes
Anticipated regulations to become effective January 2008 -
- Require district and test site coordinators to sign security agreements stating coordinators will ensure that all test examiners are trained to administer the examination in compliance with the test administration manuals
- Permit grade eleven students to take the CAHSEE in successive administrations

- Require school districts to provide grade twelve and adult education students at least three opportunities per school year to take sections of CAHSEE not yet passed
- Allow English learners to have access to translation glossaries (English to primary language and/or primary language to English) if used in classroom

- Prior to using unlisted test variations districts must receive CDE approval
- By December 31 of each year, LEA must report to CDE data regarding the local waivers granted pursuant to Education Code Section 60851(c)
- By February 1, 2008, LEAs must submit to CDE data regarding the exemptions granted pursuant to Education Code Section 60852.4

Valenzuela Settlement
On August 13, 2007, the Alameda County Superior Court approved a settlement in the case of Valenzuela v. O'Connell.
Primary terms of settlement:
- LEAs must provide intensive instruction to students for up to 2 years after completion of grade 12 for the parts of the CAHSEE not yet passed.
- For English learners, the instruction must also include services to improve English proficiency.
For the terms of the settlement to take effect, the legislature must pass Assembly Bill 347.

- Transcribe all essays onto scannable answer documents if originally recorded elsewhere.
- Use only one answer document per student; do not combine different answer documents.
- Statewide Student Identifier (SSID) numbers are required for Pre-ID for grades 10, 11, and 12.

- Order test materials on time and adhere to deadlines
- Use scheduled couriers for returning test materials

Apportionment Process
- The 2006-07 Apportionment Information Reports were mailed to districts in September 2007.
- Each school district must certify the accuracy of its Apportionment Information Report and return to CDE. Certified reports must be postmarked by December 31, 2007.
- If postmarked after this date, the reports must be accompanied by a waiver request as provided by Education Code Section 33050.

Student Results Retention Requirements
- Districts must maintain in each student's permanent record the following information:
- The date(s) the student took the CAHSEE.
- Whether the student satisfied the CAHSEE requirement for each section of the exam.
- Must be entered in the student's permanent record within 60 days of receiving data files from test contractor.

Student Results Retention Requirements (continued)
- Districts are required to provide CAHSEE scores to student's new district if student moves, even if student owes fee. Education Code, Section 49068 and California Code of Regulations 438.

- The CAHSEE Regulations identify:
- Variations for all students
- Variations for English learners
- Accommodations for students with disabilities
- Modifications for students with disabilities

Test Variations (continued)
- English learners must be provided with certain test variations if regularly provided in the classroom or used for assessment.
- Students with disabilities must be allowed to take the CAHSEE with any accommodations or modifications specified in their IEP or Section 504 Plan.

Local Waiver
- Education Code Section 60851(c) explains the waiver process in detail.
- At the request of the student's parent or guardian, a school principal must submit to the local school board a request for a waiver of the requirement to pass the part(s) of the CAHSEE on which a modification was used and the equivalent of a passing score was earned.

Local Waiver Process
For the local board to waive the CAHSEE requirement, the principal must certify the pupil has:
- An IEP or Section 504 Plan that requires the modifications to be provided to the pupil when taking the CAHSEE.
- Completion, or in the process of completion, of high school-level coursework sufficient to have attained the skills and knowledge otherwise needed to pass the CAHSEE.
- A score report showing that the student received the equivalent of a passing score on the CAHSEE while using a modification.

Exemption for Certain Students with Disabilities
- Education Code Section 60852.4 provides an exemption of the CAHSEE requirement to certain students with disabilities scheduled to receive a diploma in 2007.
- Eligibility Verification Forms should be used to document student eligibility for this exemption.
- This law is in effect through December 31, 2007.

Test Variations, Local Waiver, and Exemption for Adult Students with Disabilities
- Adult students with disabilities are eligible for test variations, including accommodations and modifications, as well as the local waiver request process and exemption.
- Students with disabilities can receive educational services under an IEP until age 22.
- All adult students requiring special educational services may receive such services under a Section 504 Plan.

Remediation
- Education Code Section 37252 - Districts must provide remediation to students in grades 7 through 12 who do not show sufficient progress toward passing the CAHSEE.
- Education Code Section 37254 (Intensive Instruction and Services Grant):
- Provides $72.4 million statewide.
- All LEAs that apply will receive funding after October 1, 2007.
- LEAs will receive up to $520 for each grade 12 student who has not passed one or both parts of the CAHSEE.
- Any remaining funds be distributed to LEAs for grade 11 students.
