Seventh Apportionment for Title III, Part A,
English Language Acquisition, Language Enhancement, and
Academic Achievement for Immigrant Students
Every Student Succeeds Act
Fiscal Year 2016–17
This apportionment, in the amount of $955,306, is made from federal funds provided to the state under Title III, Part A of the Elementary and Secondary Education Act of 1965 (ESEA), as amended by the Every Student Succeeds Act (ESSA) (Public Law 114-95). Title III, Part A Immigrant funds are apportioned to local educational agencies (LEAs) to provide supplementary academic support and educational services to immigrant students.
Only those LEAs that applied for Title III, Part A Immigrant funds on the 2016–17 Consolidated Application Reporting System (CARS), had a State Board of Education approved LEA Plan as of March 2017, and met federal cash management thresholds are included in this apportionment. The amount paid to each LEA was determined based on information reported by the LEA in the Cash Management Data Collection (CMDC) system. Each LEA’s payment equals 25 percent of the Title III, Part A Immigrant allocation, minus the cash balance reported as of January 31, 2018, adjusted for funds previously paid. The California Department of Education (CDE) implemented cash management in order to reduce the time elapsing between the receipt and disbursement of federal funds, pursuant to the cash management requirements under federal statute and regulations. Allocation amounts are equal to the number of immigrant students reported on the Fall 2015 California Longitudinal Pupil Achievement Data System multiplied by a rate of $86.45. Allocation amounts have been adjusted for LEAs that failed to meet the federal maintenance of effort requirement applicable to 2016–17 funding and did not receive an approved federal waiver, pursuant to Section 9521 of the ESEA and Title 34 of the Code of Federal Regulations (CFR) Part 299, Subpart D, Section 299.5. The LEAs have the option to consolidate and use Title III, Part A funds with other federal, state, and local funds for schoolwide programs pursuant to Section 1114 of the ESEA and Title 34 of the CFR, Part 200, Subpart A, sections 200.25 through 200.29. The United States Department of Education (ED) grant award number for this funding is S365A160005. The Catalog of Federal Domestic Assistance subprogram number is 84.365A (English Language Acquisition Grants). The funding is appropriated in Schedule (3) of Item 6100-125-0890 of the Budget Act of 2016 (Chapter 23, Statutes of 2016). The California sub-allocation (pass-through) number is Program Cost Account (PCA) 15146.
This grant award is subject to the provisions of Title III, Part A and Title IX, of the ESEA, as applicable, and the General Education Provisions Act. This grant is also subject to the General Provisions in 34 CFR Part 299, and the Education Department General Administrative Regulations in 34 CFR parts 76, 77, 81, 82, and 85, and the Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards in 2 CFR Part 200.
An LEA whose LEA plan is approved after the start of fiscal year 2016–17 may charge to this program only those costs incurred subsequent to substantial approval of the plan by the State Board of Education. Under the federal Tydings Amendment, Section 421(b) of the General Education Provisions Act, any funds that are not obligated at the end of the federal funding period, July 1, 2016, through September 30, 2017, shall remain available for obligation for an additional period of 12 months, through September 30, 2018.
Pursuant to 2 CFR, Section 200.305(b)(9), interest earned amounts up to $500 per year may be retained by the non-Federal entity for administrative expense. Any additional interest earned on Federal advance payments deposited in interest-bearing accounts must be remitted annually. LEAs should forward interest payments for remittance to the ED to:

Warrants will be mailed to each county treasurer approximately three weeks from the date of this Notice. For standardized account code structure coding, use Resource Code 4201, Title III, Immigrant Education Program, and Revenue Object Code 8290, All Other Federal Revenue.
County superintendents were notified of this apportionment by e-mail sent to their CDEfisc e-mail addresses.
