Action: Tuesday, June 7, 2016, and Tuesday, October 4, 2016
Commissioner Ryan moved approval of minutes.
Commissioner Washington seconded the motion.
Yes votes: Commissioners Bauer, Chan, Engelberg, O'Halloran, Ryan, Sever, and Washinton
No votes: None
Members absent: Commisioner Howard
Abstentions: Commissioner Gundry
The motion passed with seven votes and one abstention.

Subject: Consideration of Retroactive Requests for Determination of Funding as Required for Nonclassroom-based Charter Schools Pursuant to California Education Code Sections 47612.5 and 47634.2, and Associated California Code of Regulations, Title 5.
CDE Recommendation: The CDE proposes to recommend that the SBE approve the determination of funding requests for the percentages and periods specified for the nonclassroom-based charter schools provided in Attachment 1.
Action: Commissioner Ryan moved recommendation to the SBE of the CDE staff recommendation.
Commissioner Engelberg seconded the motion.

ITEM 02
Subject: Consideration of a Retroactive Request for Determination of Funding with "Reasonable Basis"/Mitigating Circumstances as Required for a Nonclassroom-based Charter School Pursuant to California Education Code Sections 47612.5 and 47634.2, and Associated California Code of Regulations, Title 5.
CDE Recommendation: The CDE proposes to recommend that the SBE deny River Valley Charter's mitigating circumstances request and approve a determination of funding of 85 percent for two years, fiscal years 2016–17 through 2017–18, as provided in Attachment 1.
Action: Commissioner Sever moved recommendation to the SBE that the SBE accept River Valley Charter's mitigating circumstances request and approve 100 percent funding for the period specified in Attachment 1.
Commissioner O'Halloran seconded the motion.
Yes votes: Commissioners Engelberg, O'Halloran, Ryan, Sever, and Washington
No votes: Commissioners Bauer, Chan, and Gundry

The motion passed by a vote of five to three.

CDE Recommendation: The CDE proposes to recommend that the SBE approve the mitigating circumstances request for Escalon Charter Academy and approve the determination of funding and period specified as provided in Attachment 1.
Action: Commissioner Engelberg moved recommendation to the SBE of the CDE staff recommendation.
Commissioner Sever seconded the motion.
