Supplemental Instruction: Core Academic, Kindergarten through Twelfth Grade (Flexible Funds)


Funding Description

Funding for this program is unrestricted pursuant to SBX3 4 (Chapter 12, Statutes of 2009), enacted February 2009. For additional information, please refer to the Action on 2008 and 2009 Budget Acts Web page.

Before 2008-09, the funds were allocated to school districts, county offices of education and charter schools (local educational agencies) that provided programs of direct, systematic, and intensive supplemental instruction to pupils in kindergarten through twelfth grade, inclusive. Subject areas included are those that are in the course of study adopted by the governing board. (Core academic courses for first through sixth grade include English, Mathematics, Social Sciences, Science, Visual & Performing Arts, Health, and Physical Education; and for seventh through twelfth grade include English, Social Sciences, Foreign languages, Physical Education, Science, Mathematics, Visual & performing arts, Applied Arts, Career Technical Education, and Automobile Driver Education. Other courses adopted by the governing board may also be included.)

Required Eligibility Criteria Local educational agencies (LEAs) that received funding in 2007-08 and direct-funded charter schools that began operation in 2008-09 and received funding at the Recertified First Principal Apportionment are eligible for funds.

Legal Authority Education Code Section 42605. Funds appropriated in item 6110-104-0001(4) of the Budget Act of 2009 (Chapter 1 of the 2009-10 Third Extraordinary Session) as amended by ABX4 1 (Chapter 1 of the 2009-10 Fourth Extraordinary Session), and in Section 38 of SBX3 4 (Chapter 12, Statutes of 2009).

Allocation Formula Of the total $70,009,000 funding available, $47,973,000 is available in 2009-10 and $22,036,000 is deferred until 2010-11.

Funding for this program from fiscal years 2008-09 through 2012-13 will be based on 2007-08 and 2008-09 (direct-funded charter schools that began operation in 2008-09) funding levels. LEAs will receive the same percentage of the available funding as they received from the allocated funds in 2007-08 or 2008-09 (direct-funded charter schools that began operation in 2008-09).

Flexibility Action on the 2008 and 2009 Budget Acts
Other The funding for this program is now flexible pursuant to Education Code Section 42605. LEAs may utilize all of their program funds to provide services for the program or they may use all or part of their program funds for other education purposes and/or other categorical programs.

Funds are paid through the Principal Apportionment. Principal Apportionment amounts are calculated three times for each fiscal year: The First Principal Apportionment (P-1) is certified by February 20th, the Second Principal Apportionment (P-2) is certified by July 2nd, and the Annual calculation is certified by February 20th of the following year (at the same time as the following year's P-1 certification).
