USDA Child Nutrition Responses #26, #30, #32
On June 8, 2020, as part of the COVID-19 Families First Coronavirus Response Act, the USDA issued the following Child Nutrition Programs (CNP) flexibility waiver extensions as part of the COVID-19 Child Nutrition Response Act:

Child Nutrition Response #26 extends the meal pattern flexibility from June 20, 2020, to July 31, 2020, for operators of the National School Lunch Program (NSLP) which includes Seamless Summer Option (SSO), School Breakfast Program (SBP), Child and Adult Care Food Program (CACFP), and Summer Food Service Program (SFSP). Before using this flexibility, organizations must first notify the California Department of Education (CDE) of their intent to use the waiver. The meal pattern flexibility waiver is located at Extension of COVID-19 CNP Meal Pattern Waiver. Please note, the waiver application is the notification to the CDE of your intent.
- COVID-19: Child Nutrition Response #30, Nationwide Waiver of Onsite Monitoring Requirements for Sponsoring Organizations in the Summer Food Service Program – EXTENSION (PDF)
Child Nutrition Response #30 extends the monitoring flexibilities expiration from June 30, 2020, to August 31, 2020, for operators of the SFSP. Before using this flexibility, SFSP organizations must first notify the CDE of their intent to use the waiver. The CNP monitoring flexibility waiver application is located at CNP Monitoring Flexibility Waiver Application. Please note, the application is the notification to the CDE of your intent to use the monitoring flexibility waiver. If you have already completed an application, no further action is needed. Once you submit the application, you will receive an email notification from the CDE of your CNP Flexibility Waiver approval.

- COVID-19: Child Nutrition Response #32, Nationwide Waiver to Extend Area Eligibility Waivers through August 31, 2020
Child Nutrition Response #32 extends the area eligibility flexibilities for previously approved Statewide waiver from June 30, 2020, to August 31, 2020, for operators of the SSO and SFSP. For open sites, the area eligible waiver allows the CDE to replace the 50 percent threshold with a lower 40 percent threshold. For sites that are below the 40 percent FRP threshold, the CDE can accept from CNP sponsors additional reasons of how the eligibility rates have changed due to COVID-19, e.g., percentage of business closures in the area, increase in SNAP participation, increase participation in local food banks, or increased unemployment. To participate in this waiver, an SSO or SFSP sponsor must complete the streamlined online Area Eligibility Waiver Application. If you have already completed the Application, no further action is needed.
