On September 22, 2021, the U.S. Department of Agriculture (USDA) Food and Nutrition Service released several policy memos that provide flexibilities for service institutions operating the Summer Food Service Program (SFSP) during unanticipated school closures due to COVID-19. Response #105 also applies to school food authorities (SFA) operating the Seamless Summer Option (SSO). Response #106 provides state agency reporting requirement flexibilities.

The following waivers are available for use during the 2021–22 School Year (SY) during unanticipated school closures:

These USDA waivers specify that unanticipated school closures only occur when instruction is not provided to children. If a school plans to offer virtual learning or a mix of in-person classes and virtual learning, the school is considered open and any meals provided must be offered through the SSO.
