COVID-19: Child Nutrition Response 99
On September 15, 2021, the U.S. Department of Agriculture (USDA) released COVID-19 Child Nutrition Response #99: Nationwide Waiver of the Annual Half Aggregate Monitoring Requirement in the Summer Food Service Program (SFSP). Based on the ongoing COVID-19 public health emergency, the USDA is waiving the requirement that the California Department of Education (CDE) Nutrition Services Division (NSD) annually review a number of sponsors whose program reimbursements, in the aggregate, account for at least one-half of the total program reimbursements in the state in the previous year. While the SFSP review requirements found at Title 7, Code of Federal Regulations (7 CFR), Section 225.7(d)(2)(ii)(B), have been waived until September, 30, 2022, the NSD will need to continue to review SFSP Operators based on the following federal regulations:
- 7 CFR 225.7(d)(2)(ii)(A) Conduct a review of every new sponsor at least once during the first year of operation;
- 7 CFR 225.7(d)(2)(ii)(C) Annually review every sponsor which experienced significant operational problems in the prior year;
- 7 CFR 225.7(d)(2)(ii)(D) Review each sponsor at least once every three years; and
- 7 CFR 225.7(d)(2)(ii)(E) As part of each sponsor review, conduct reviews of at least 10 percent of each sponsor’s sites, or one site, whichever number is greater.
