Emergency Noncompetitive Solicitations
As the California Department of Education (CDE) learns of school closures, we want to remind all program operators of the flexibilities provided by Title 2, Code of Federal Regulations, Section 200.320(f)(2), noncompetitive procurements resulting from a public emergency.
If you have any supply chain disruptions from school closures or other COVID-19 impacts, this provision in federal regulations allows you to use a noncompetitive solicitation to ensure your children continue to receive meals.
As a reminder, you must continue to document your procurements and maintain those records for the appropriate allotment of time.
While we navigate through this public emergency, the CDE will continue to keep you apprised of any new information or resources available to the Child Nutrition Programs.
