Summer 2022 CNP Waiver Elections


The California Department of Education (CDE) Nutrition Services Division (NSD) is pleased to announce the release of online application for the Summer 2022 and Child Nutrition Programs (CNP) Administration Waiver Elections.

This application will be open through September 30, 2022. You may opt into these waivers at any time; however, the CDE recommends Program Operators proactively complete the application as soon as possible. Program Operators may update waiver selections by submitting additional applications as needed.

Documentation Requirements for Noncongregate Meals, Parent Pick Up, Meal Service Time and Offer versus Serve (OVS)

For reporting purposes, the CDE is requiring CNP operators maintain documentation of the impact of COVID-19 on meal service, and, in particular, how it relates to the use of the following waivers: noncongregate meals, parent pick up, meal service time and OVS.

Below is a set of examples that, should they impact your summer meal service, would support the need for the use of these flexibilities and should to be documented by CNP Operators:

  • School or site closure due to COVID-19
  • Classroom quarantine due to COVID-19
  • Student illness or quarantine due to COVID-19
  • Staff shortages due to COVID-19 illness or quarantine
  • Mandate or recommendation from national, state, or local governing body not to congregate due to COVID-19
  • Service to groups where the majority are unvaccinated (For example, children under five years old, while COVID-19 vaccinations for this age group are rolling out or immune compromised groups).
  • Documented delays in obtaining supplies and equipment due to COVID-19 that prevents the ability to provide congregate meal service
    • Note: this waiver flexibility can be used for these groups only and may not apply to the broader population served or entire campuses
  • Documented delays in obtaining supplies and equipment due to COVID-19 that prevents the ability to provide congregate meal service

Reporting Requirements

All CNP Operators opting in to any waiver must complete the online waiver election application and participate in the mandatory reporting at the conclusion of Summer meal service.

At minimum, Program Operators will be required to report a description of how each waiver impacted meal service operations at participating sites, whether the waivers resulted in improved services to children and how the waivers reduced administrative burden, especially the quantity of paperwork, as applicable.
