SP 18-2021: CEP Operations during SY 2021-22: Q&As

On July 22, 2021, the U.S. Department of Agriculture (USDA) issued Policy Memorandum SP 18-2021: Community Eligibility Provision (CEP) Operations during School Year (SY) 2021–22: Questions and Answers. The policy memo provides clarification to state agencies and program operators that participate or intend to participate in CEP while operating under nationwide waivers and during regular National School Lunch Program and School Breakfast Program operations. In addition, the policy memo addresses the following:

  • Confirms that program operators who participate in CEP must still count SYs 2020–21 and 2021–22 as part of their 4-year CEP cycle, even if they operated under the Seamless Summer Feeding Option during those years
  • Encourages program operators to consider electing CEP beginning in SY 2021–22, even if operating under the Seamless Summer Feeding Option
  • Specifies that program operators need to use SY 2020–21 data if applying for SY 2021–22, and establishes deadlines for applications and data time frames
  • Confirms notification, direct certification, and claiming requirements
