Targeted Level 3

Local educational agencies (LEAs) that have been identified as Targeted Level 3 are required to participate in all three steps of the Compliance and Improvement Monitoring process. This is the home page for that Level.

An LEA identified as Targeted Level 3 in the March 20, 2023, Annual Determination Letter, is required to participate in all three steps of the Compliance and Improvement Monitoring (CIM) process, with some activities conducted independently, some with the assistance and guidance of a technical assistance provider, some with special education local plan area (SELPA), and some with California Department of Education (CDE) support. By the end of the 2023 monitoring period, the LEA is required to have a fully developed improvement plan that seeks to implement high leverage activities which will improve outcomes for students with disabilities in the areas identified by the Annual Determination Letter.

The CDE identifies LEAs for Targeted Level 3 monitoring in one or more of the three ways:

  1. The LEA is identified as disproportionate for two or more years
  2. The LEA is ranked in the bottom 11–20% of either the Intensive Evaluation or Preschool Intensive Evaluation
  3. The LEA is ranked in the bottom 10% for any of the Least Restrictive Environment (LRE) Indicators.

LEAs identified for Targeted Level 3 monitoring and support are required to attend all trainings as outlined below in the Trainings table. Targeted Level 3 LEAs will conduct all activities of the CIM steps independently, with the support of their SELPA and the CDE. The LEA will utilize guidance and materials provided by the CDE to develop a CIM Team, conduct an independent data drill down and review of the procedural compliance elements associated with the targets or areas in need of review, perform a root cause analysis, and develop an improvement plan. Please review the table titled CIM Due Dates for the specific dates that each CIM step is due to the LEA’s SELPA.
