Funding Description

Funding supports the education of students with disabilities as defined by the Individuals with Disabilities Education Act (IDEA). The affected state agencies are the State Special Schools, particularly, the California School for the Blind and the California School for the Deaf in Fremont; the California School for the Deaf in Riverside; the California Department of Corrections and Rehabilitation, Division of Juvenile Justice (formerly California Youth Authority), and the Department of Developmental Services (DDS).

Required Eligibility Criteria To receive the first 50 percent of these one-time funds no additional assurance requirements are necessary because CDE accepts the assurances the local educational agencies (LEAs) provided in the 2008-09 consolidated and local plan applications. To receive the second 50 percent of these funds, CDE will verify that the LEA has submitted 2009-10 consolidated and local plan applications that contain assurances to the state education agency that is consistent with federal and state laws and regulations.
Other Eligibility Considerations LEAs must account for these funds as expenditures for pupils with an individualized education plan (IEP) and for the provision of the special education and related services required by students with disabilities in order to benefit from a public education.

Allocation Formula The State Institutions grant is one of three portions of the federal Section 611, Part B IDEA. Funding is based on a federal three part formula: a 1999 Special Education enrollment, population (K-12 enrollment public and private), and poverty (free and reduced meal counts K-12).

Other ARRA funds may be forward funded for the time period February 17, 2009, to June 30, 2009, but are available to September 30, 2011. The first 50 percent of the total available are from state spending authority in fiscal year 2008-09. The ARRA funds shall be reported as fiscal year 2009-10.
