Dear County Superintendent of Schools:

Proposed Recovery of Unspent Funds for
Proposition 39 California Clean Energy Jobs Act

The proposed recovery of payment for Proposition 39 California Clean Energy Jobs Act (Proposition 39), in the amount of $26,600,333.06, is made in accordance with California Public Resources Code (PRC) Section 26240(h)(1), which requires local education agencies (LEAs) to pay back funds not used in accordance with statute or regulations. The Proposition 39 Guidelines required approved Proposition 39 projects to be completed by June 30, 2021, and PRC 26240(b) required LEAs to report expenditures no later than 15 months after completing eligible projects. The amount of this recovery is based on the expenditure amounts reported by LEAs to the California Energy Commission.

LEAs will have until February 27, 2026 (approximately six weeks) to review the proposed recovery amounts prior to the recovery action that will be completed by April 2026.

For Standardized Account Code Structure coding, use Resource Code 6230, California Clean Energy Jobs Act, and Revenue Object Code 8590, All Other State Revenue.
