Dear County Superintendent of Schools:

Recovery of Unspent Funds for
Proposition 39 California Clean Energy Jobs Act

This recovery of payment for Proposition 39 California Clean Energy Jobs Act (Proposition 39), in the amount of $12,980,199.31, is made in accordance with California Public Resources Code (PRC) Section 26240(h)(1), which requires local education agencies (LEAs) to pay back funds not used in accordance with statute or regulations. The Proposition 39 Guidelines require approved Proposition 39 projects to be completed by June 30, 2021, and PRC 26240(b) requires LEAs to report expenditures no later than 15 months after completing eligible projects. The amount of this recovery is based on the expenditure amounts reported by LEAs to the California Energy Commission.

The September 2023 Principal Apportionment warrants for selected counties were reduced by the amount of unspent Proposition 39 funds, as shown on the accompanying Schedule of Recovery. The county superintendents of schools were notified of this recovery by email, which was sent to their CDEfisc email addresses.
