Dear Expanded Learning Program Grantees:

Partnership Restructure

Effective January 1, 2017, grantees are permitted to request a partnership restructure.

About Restructuring of a Partnership

A group of eligible entities may apply for and receive an After School Education and Safety (ASES), After School Safety and Enrichment for Teens (ASSETs) or 21st Century Community Learning Centers (CCLC) grant as a partnership or consortium. A partner listed on the grant has legal responsibility over the program. Partnerships/consortia may be restructured if all of the following conditions are met:

  1. All partners or consortium members agree to the restructure.
  2. The new structure complies with the requirements of California Education Code (EC) Section 8421(f)(8) (if an ASSETs grant), or Section 8482.3(f) (if an ASES or 21st CCLC grant), as applicable.
  3. There is no change in the school, or schools, served by the restructured partnership or consortium.
  4. The department agrees to the restructure.
Requirements for Restructuring of a Partnership
  • For ASES programs, the program plan needs to reflect the current programming.
  • For 21st CCLC and ASSETs programs, the grantees must implement the program outlined in the original grant application.
  • For 21st CCLC and ASSETs programs, grantees must have a co-applicant.

Question: What happens when one partner wants to leave a partnership but the other partner does not want the change?

Answer: As stated in EC, all partners must agree to the restructure, otherwise it cannot be approved (EC sections 8426[a][4] and 8482.4[c][2]).

Question: Can a grant add or delete partners during restructuring?

Answer: Yes. If all of the requirements are met as outlined in EC (EC sections 8426[a][4] and 8482.4[c][2]).
