Subject: Consideration of Requests for Determination of Funding as Required for Nonclassroom-Based Charter Schools Pursuant to California Education Code sections 47612.5 and 47634.2, and Associated California Code of Regulations, Title 5.

CDE Recommendation: The CDE proposes to recommend that the California State Board of Education (SBE) approve the schools’ determination of funding requests at the percentages and for the time periods as specified in Item 01 Attachment 1: Proposed Recommendations for Nonclassroom-Based Determinations of Funding (XLSX).

Actions:

  • Motion 1: Commissioner King moved for recommendation to the SBE of the CDE staff recommendation for all schools listed in Attachment 1 with the exception of the following:

    • CORE Butte Charter, Charter #0945
    • Excelsior Charter, Charter #1910
    • Excelsior Charter School Corona-Norco, Charter #1993
    • Keyes to Learning Charter, Charter #0085
    • Visions In Education, Charter #0248
    • William Finch, Charter #0634

    Commissioner Brasil seconded the motion.

Item 02

Subject: Consideration of Requests for Determination of Funding with “Reasonable Basis”/Mitigating Circumstances as Required for Nonclassroom-Based Charter Schools Pursuant to California Education Code sections 47612.5 and 47634.2, and Associated California Code of Regulations, Title 5.

CDE Recommendation: The CDE proposes to recommend that the SBE take action on all charter schools’ mitigating circumstances requests and determination of funding requests as specified in Item 02 Attachment 1: Proposed Recommendations for Nonclassroom-Based Determinations of Funding with Mitigating Circumstances (XLSX).

Actions:

  • Motion 1: Commissioner Finnell moved for recommendation to the SBE that all schools listed in Attachment 1, with the exception of Opportunity Youth Academy, Charter #1840, be approved at 100 percent funding for two fiscal years (i.e., 2023–24 and 2024–25).

    Commissioner King seconded the motion.

    Yes votes: Commissioners Brasil, Finnell, King, Olmos, Taylor, and Walsh
    No votes: Commissioners Farland and Jones
    Members absent: None
    Abstentions: None

    The motion passed by a vote of six to two.
  • Motion 2: Commissioner Taylor moved for recommendation to the SBE that Opportunity Youth Academy, Charter #1840 be approved at 100 percent funding for two fiscal years (i.e., 2023–24 and 2024–25).

Item 03

Subject: Reconsideration of a Request for Determination of Funding as Required for Nonclassroom-Based Charter Schools Pursuant to California Education Code sections 47612.5 and 47634.2, California Code of Regulations, Title 5 Section 11963.6(g), and Associated California Code of Regulations, Title 5.

CDE Recommendation: The CDE proposes to recommend that the SBE approve Guajome Learning Center’s reconsideration request and increase its current funding determination level from 85 percent to 100 percent for fiscal years 2022–23 and 2023–24.

Actions:

  • Motion 1: Commissioner Finnell moved for recommendation to the SBE to deny Guajome Learning Center’s reconsideration request and to retain its current funding determination level at 85 percent for fiscal years 2022–23 and 2023–24.

    No commissioner seconded the motion; the motion failed.
  • Motion 2: Commissioner King moved for recommendation to the SBE of the CDE staff recommendation to approve Guajome Learning Center's reconsideration request and increase its current funding determination level from 85 percent to 100 percent for fiscal years 2022–23 and 2023–24.

    Commissioner Taylor seconded the motion.

    Yes votes: Commissioners Brasil, Farland, King, Olmos, Taylor, and Walsh
    No votes: Commissioners Finnell and Jones

Item 04

Subject: T.I.M.E. Community: Consider Evidence Regarding a Notice of Violation Issued by the California State Board of Education, pursuant to California Education Code Section 47607(g), and Propose that the California State Board of Education Issue a Notice of Intent to Revoke with Notice of Facts, pursuant to California Education Code Section 47607(h).

CDE Recommendation: The CDE proposes to recommend that the SBE issue a Notice of Intent to Revoke with Notice of Facts to T.I.M.E. Community, pursuant to California Education Code Section 47607(h), at its May 18–19, 2023, meeting as T.I.M.E. Community has failed to adequately refute, remedy, or propose to remedy the violations outlined in the Notice of Violation that was issued to the school by the SBE on March 9, 2023.

Action: Commissioner Jones moved for recommendation to the SBE of the CDE staff recommendation.

Commissioner Brasil seconded the motion.

No votes: None
Members absent: None
Abstentions: None

The motion passed unanimously.
