County Oversight: Valenzuela Case Settlement (Flexible Funds)


Funding Description

Funding for this program is unrestricted pursuant to SBX3 4 (Chapter 12, Statutes of 2009), enacted February 2009. For additional information, please refer to the Action on 2008 and 2009 Budget Acts Web page.

Before 2008-09, the funds were restricted for county office of education (COE) oversight purposes as part of the Valenzuela v. O'Connell (Valenzuela) case settlement. COE oversight includes verifying that eligible pupils of local educational agencies participating in the California High School Exit Exam Intensive Instruction and Services program are informed that they are entitled to receive intensive instruction and services for up to two consecutive academic years after completion of grade 12 or until the pupil has passed both parts of the exam. In addition, COEs verify that pupils who have elected to receive CAHSEE intensive instruction and services are being served.

Other Funding for this program is among those that are generally flexible pursuant to SBX3 4 Section 15, Education Code (EC) Section 42605, enacted in February 2009. However, Assembly Bill X4 2 Section 15, enacted in July 2009 imposed additional restrictions related to this program by requiring county offices of education to fulfill all of the requirements of EC Section 1240. EC Section 1240 (c)(2)(E) requires COEs to verify that eligible pupils have been notified of their entitlement to CAHSEE intensive instruction services and that those who elect to receive such services are being served.
