Dear County Superintendents of Schools:

First Apportionment for Title III, Part A
English Language Acquisition, Language Enhancement, and
Academic Achievement for Immigrant Students
Every Student Succeeds Act
Fiscal Year 2020–21

This apportionment, in the amount of $737,357, is made from federal funds provided to the state under Title III, Part A of the Elementary and Secondary Education Act of 1965 (ESEA), as amended by the Every Student Succeeds Act (ESSA) (Public Law 114-95). Title III, Part A Immigrant funds are apportioned to local educational agencies (LEAs) for supplementary programs and services to immigrant students.

Only those LEAs that applied for Title III, Part A Immigrant funds on the 2020–21 Consolidated Application Reporting System (CARS) by August 14, 2020, submitted the Local Control and Accountability Plan Federal Addendum, and met federal cash management thresholds are included in this apportionment. The amount paid to each LEA was determined based on information reported by the LEA in the Cash Management Data Collection (CMDC) system. Each LEA’s payment equals 25 percent of the Title III, Part A, Immigrant allocation, minus the cash balance reported as of July 31, 2020, adjusted for funds previously paid. LEA preliminary allocation amounts are equal to the number of immigrant students reported on the Fall 2019 California Longitudinal Pupil Achievement Data System (CALPADS) multiplied by a rate of $104.70. Allocation amounts have been adjusted for LEAs that failed to meet the federal maintenance of effort requirement applicable to 2020–19 funding and did not receive an approved federal waiver, pursuant to Section 8521 of the ESEA. Amounts paid in this apportionment are listed on the schedule of apportionment posted on the California Department of Education’s (CDE) Categorical Programs web page at https://www.cde.ca.gov/fg/aa/ca/.

LEAs have the option to consolidate and use Title III, Part A Immigrant funds with other federal, state, and local funds for schoolwide programs pursuant to Section 1114 of the ESEA and Title 34 of the Code of Federal Regulations (CFR) Part 200, Subpart A, sections 200.25 through 200.29. The United States Department of Education (ED) grant award number for this funding is S365A200005. The Catalog of Federal Domestic Assistance subprogram number is 84.365A (English Language Acquisition Grants). The funding is appropriated in Schedule (3) of Item 6100-125-0890 of the Budget Act of 2020 (Chapter 6, Statutes of 2020). The California sub-allocation (pass-through) number is Program Cost Account (PCA) 15146.

This grant is subject to the provisions of Title III, Part A and Title VIII of the ESEA, as applicable, and the General Education Provisions Act (Public Law 103-382). This grant is also subject to the regulations in 34 CFR Part 200; the Education Department General Administrative Regulations in 34 CFR parts 76 (except for 76.650–76.662, Participation of Students Enrolled in Private Schools), 77, 79, 81, 82, 84, 97, 98, and 99; the Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards in 2 CFR Part 200; and 2 CFR Part 3485. Regulations regarding Participation of Eligible Children in Private Schools are found in 34 CFR sections 200.62–200.67.

Under the federal Tydings Amendment, Section 421(b) of the General Education Provisions Act, any funds that are not obligated at the end of the federal funding period, July 1, 2020, through September 30, 2021, shall remain available for obligation for an additional period of 12 months, through September 30, 2022.

Pursuant to 2 CFR Section 200.305(b)(9), interest earned amounts up to $500 per year may be retained by the non-Federal entity for administrative expense. Any additional interest earned on Federal advance payments deposited in interest-bearing accounts must be remitted annually. LEAs should forward interest payments for remittance to the ED to:

To ensure proper posting of payments, please indicate the program’s PCA number (PCA 15146), and identify the payment as “Federal Interest Returned.”

Warrants will be mailed to each county treasurer approximately three weeks from the date of this Notice. For standardized account code structure coding, use Resource Code 4201, ESSA: Title III, Immigrant Student Program, and Revenue Object Code 8290, All Other Federal Revenue.

County superintendents were notified of this apportionment by email sent to their CDEfisc email addresses. The CDE requested that the email be forwarded to all school districts and charter schools in the county, and included the links to this letter and the accompanying apportionment schedule posted on the CDE web page at https://www.cde.ca.gov/fg/aa/ca/.
