Purpose

The purpose of this Management Bulletin (MB) is to advise California State Preschool Program (CSPP) contractors that family fees for part-day services are repealed as of July 1, 2014. In addition, MB 12-06 and MB 13-06 are rescinded, which previously authorized CSPP contractors to assess and collect family fees from families enrolled and receiving part-day services.

It is also a reminder  to CSPP contractors that they must issue a Notice of Action (NOA) to families stating that an assessment of a family fee for children enrolled in part-day CSPP will no longer be collected.

Background

California Education Code (EC), Section 8237 allows CSPP contractors providing part-day services to enroll children up to 120 days before the start of the program year.

The Budget Act of 2012 (Senate Bill 1016) added EC, Section 8239(e) and amended EC, sections 8263 (g) and (h) requiring agencies to assess family fees for families enrolled in a part-day CSPP.

The Budget Act of 2014 (Senate Bill 858) amended EC Section 8273.2, and added EC Section 8273.1 (e), exempting families whose children are enrolled in part-day CSPP from being assessed a family fee.

Directives

Effective July 1, 2014, families enrolled in a part-day CSPP as described in EC, Section 8235(d) will no longer be subject to a family fee, and contractors should no longer assess and collect family fees for families enrolled in a part-day CSPP.

Contractors that have assessed a fee for families enrolled for part-day CSPP in fiscal year 2014–15 must issue a NOA to families repealing the assessment of the family fee.
