Fourth Apportionment for Title I, Part A, Improving
Basic Programs Operated by Local Educational Agencies
Every Student Succeeds Act
Fiscal Year 2019–20
This apportionment, in the amount of $258,879,544, is made from federal funds provided to the state under Title I, Part A, Improving Basic Programs Operated by Local Educational Agencies, of the Elementary and Secondary Education Act of 1965 (ESEA), as amended by the Every Student Succeeds Act (ESSA) (Public Law 114–95). Title I, Part A funds are apportioned to local educational agencies (LEAs) to provide supplementary academic support and educational services to students who are failing or most at-risk of failing to meet the state standards in core academic subjects.
Only those LEAs that applied for Title I, Part A funds on the 2019–20 Consolidated Application Reporting System (CARS) by March 31, 2020, submitted the Local Control and Accountability Plan Federal Addendum, and met federal cash management thresholds by April 30, 2020, are included in this apportionment. The amount paid to each LEA was determined based on information reported by the LEA in the Cash Management Data Collection (CMDC) system. Each LEA’s payment equals 25 percent of the Title I, Part A allocation, minus the cash balance, adjusted for funds previously paid. The California Department of Education (CDE) implemented cash management in order to reduce the time elapsing between the receipt and disbursement of federal funds, pursuant to the cash management requirements under federal statute and regulations. Allocation amounts have been adjusted for LEAs that failed to meet the federal maintenance of effort requirement applicable to 2019–20 funding and did not receive an approved federal waiver, pursuant to Section 8521 of the ESEA. Amounts paid in this apportionment are listed on the schedule of apportionment posted on the CDE Categorical Programs web page at https://www.cde.ca.gov/fg/aa/ca/.
LEAs have the option to consolidate and use Title I, Part A funds with other federal, state, and local funds for schoolwide programs pursuant to Section 1114 of the ESEA and Title 34 of the Code of Federal Regulations (CFR), Part 200, Subpart A, sections 200.25 through 200.29. The United States Department of Education (ED) grant award number for this funding is S010A190005. The Catalog of Federal Domestic Assistance subprogram number is 84.010 (Title I Grants to Local Educational Agencies). The funding is appropriated in Schedule (2) of Item 6100-134-0890 of the Budget Act of 2019 (Chapter 23, Statutes of 2019). The California sub-allocation (pass-through) number is Program Cost Account (PCA) 14329.
This grant is subject to the provisions of Title I and Title VIII of the ESEA, as applicable, and the General Education Provisions Act (Public Law 103–382). This grant is also subject to 34 CFR, Part 200; the Education Department General Administrative Regulations in 34 CFR, parts 76 (except for 76.650–76.662, Participation of Students Enrolled in Private Schools), 77, 81, and 82; the Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards in 2 CFR, Part 200; and 2 CFR, Part 3485. Regulations regarding Participation of Eligible Children in Private Schools are found in 34 CFR sections 200.62–200.67.
Under the federal Tydings Amendment, Section 421(b) of the General Education Provisions Act, any funds that are not obligated at the end of the federal funding period, July 1, 2019, through September 30, 2020, shall remain available for obligation for an additional period of 12 months, through September 30, 2021, within the limits specified in Section 1127 of the ESEA.
Section 1127 of the ESEA allows LEAs to carry over no more than 15 percent of their Title I, Part A allocations, excluding funds received through any reallocations under Section 1126(c) of the ESEA, for one additional fiscal year, unless they receive a waiver from the CDE or the total allocation is less than $50,000. At the end of the fiscal year, the CDE reviews the amount of Title I, Part A carryover funds for each LEA and issues an invoice to LEAs that exceed the carryover limit and do not receive a waiver. Pursuant to authority under the CARES Act, CDE was granted a federal funding flexibility waiver of the limitation to retain excess carryover under Section 1127 of Title I, Part A to only once every three years. This waiver permits LEAs that received an excess carryover waiver in FY 2017-18 or FY 2018-19 to receive a waiver of excess carryover in FY 2019-20. Pursuant to 2 CFR, Section 200.305(b)(9), interest earned amounts up to $500 per year may be retained by the non-Federal entity for administrative expense. Any additional interest earned on Federal advance payments deposited in interest-bearing accounts must be remitted annually. LEAs should forward interest payments for remittance to the ED to:

County superintendents were notified of this apportionment by email sent to their CDEfisc email addresses.
