Dear Select County and District Superintendents:

Recovery of Overpayments for the
In-Person Instruction Grant
Fiscal Year 2020–21

The purpose of this letter is to inform local educational agencies (LEAs) that a reduction to the September 2021 Principal Apportionment monthly payment will be made to recover amounts overpaid for In-Person Instruction (IPI) Grant.

California Education Code (EC) Section 43521(f)(1) provided advance funding for the IPI Grant to LEAs in May 2021 using 2020–21 First Principal Apportionment certification data and preliminary California Longitudinal Pupil Achievement Data System (CALPADS) Fall 1 data. Pursuant to EC Section 41521(c)(2), an LEA’s apportionment is subject to reduction, or forfeit, if the LEA did not provide in-person instruction as specified. LEAs were advised not to budget for funding if the criteria for in-person instruction could not be met. In August 2021, the final IPI Grant allocations were recalculated to reflect 2020–21 Second Principal Apportionment data and Final CALPADS Fall 1 data. In addition, funding reductions required pursuant to EC Section 41521(c)(2) were applied to LEA allocations which resulted in overpayment for select LEAs.

Pursuant to EC Section 43521(f)(1)(B), if based on the final data, the amount paid by the Controller in May 2021 exceeds the amount of state funding owed to an LEA, the California Department of Education (CDE) may offset the LEA’s monthly principal apportionment payment to recover the overpayment of funds.
